A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, PURSUANT TO SECTION 142-425(D) OF THE CITY CODE; FOLLOWING A DULY NOTICED PUBLIC HEARING, APPROVING BY 5/7TH VOTE OF THE CITY COMMISSION, THE WAIVER OF THE REQUIREMENTS OF SECTION 138-71 OF THE CITY CODE ENTITLED, "GENERAL ADVERTISING SIGNS," IN ORDER TO INSTALL THE LOGOS FOR THE GRANTORS, THE TRUST FOR PUBLIC LANDS AND TD BANK, FOR THEIR GRANT TO THE CITY OF FITNESS EQUIPMENT TO BE INSTALLED AT FLAMINGO PARK FITNESS ZONE AT FLAMINGO PARK LOCATED AT 1200 MERIDIAN AVENUE, MIAMI BEACH, FLORIDA, WHICH SIGN SHALL RECOGNIZE THE GRANTORS IN BOTH ENGLISH AND SPANISH.

Mayor and City Commission approve, pursuant to section 142-425(d), of the Land Development Regulations (LDRS); following a duly noticed public hearing, approving by 5/7^th vote of the City Commission, the waiver of the development regulations pertaining to a general advertising sign for the Flamingo Park Fitness Zone at Flamingo Park located at 1200 Meridian Avenue, Miami Beach, Florida.

At the October 18, 2017 City Commission meeting, Resolution No. 2017-30053 (Exhibit A) was approved authorizing the City to accept a donation from The Trust For Public Land (TPL), a non-profit corporation established in 1972 to conserve land for people and create parks, gardens, trails and other special places, ensuring livable communities for generations to come, in the total amount of $120,000, for the construction and installation of outdoor fitness equipment which will be located in the area approved through the Flamingo Park Master Plan.

TPL gratefully received funding to support this project through a grant awarded by TD Bank, which in turn requires them to meet particular grant requirements. One of the requirements is the placement of a “Welcome to your Flamingo Park Fitness Zone” sign, which include the TPL logo, TD Bank logo and the City of Miami Beach logo in English and Spanish (Exhibit B). The dimensions of each of the signs will be 25.625” x 39” and will be located on the NW side of the fitness zone as depicted in Exhibit C.

At the July 24, 2018 Planning Board Meeting, the board approved a Waiver of Development Regulations pertaining to a general advertising sign for the Flamingo Park Fitness Zone at Flamingo Park.

At the September 12, 2018 City Commission meeting, Resolution No. 2018-30467 (Exhibit D) was adopted accepting the recommendation of the Planning Board and setting a Public Hearing for October 17, 2018.
