SUBJECT:NORTH BEACH TOWN CENTER REZONING (6981 BYRON AVENUE AND 6948 HARDING AVENUE):
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING THE OFFICIAL ZONING DISTRICT MAP, REFERENCED IN SECTION 142-72 OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, BY CHANGING THE ZONING DISTRICT CLASSIFICATION FOR THE PARCELS AT 6981 BYRON AVENUE AND 6948 HARDING AVENUE, FROM THE CURRENT ZONING CLASSIFICATION OF GU, "GOVERNMENT USE", TO THE PROPOSED ZONING CLASSIFICATION OF TC-1, "TOWN CENTER CORE DISTRICT"; AND PROVIDING FOR CODIFICATION, REPEALER; SEVERABILITY; AND AN EFFECTIVE DATE.

RECOMMENDATION

Open and continue the subject Ordinance to a date certain of April 11, 2018.

ANALYSIS

BACKGROUND

On May 17, 2017, at the request of Commissioner Joy Malakoff, the City Commission referred the subject ordinance to the Land Use and Development Committee and Planning Board for consideration and recommendation (Item C4C).

 

On June 14, 2017, the Land Use and Development Committee recommended that the subject ordinance be approved.

 

PLANNING BOARD REVIEW

On July 25, 2017, the Planning Board transmitted the proposed Ordinance Amendment to the City Commission with a favorable recommendation.  The Planning Board also recommended that the re-zoning action be concurrent with final approval of the development agreement with North Beach Town Center Development, LLC (“NBTCD”).

 

UPDATE

The subject Ordinance was approved at First Reading on September 25, 2017, with no changes. Second Reading was scheduled for December 13, 2017, at which time the item was continued to a date certain of February 14, 2018.

 

The Finance and City Wide Projects Committee is scheduled to review the terms of the proposed Development Agreement. In order for the adoption of the Ordinance to coincide with the execution of the Development Agreement, and to allow for required noticing, the Administration recommends that the item be continued to the April 11, 2018 City Commission meeting.

CONCLUSION

Open and continue the subject Ordinance to a date certain of April 11, 2018.
