SUBJECT:REQUEST FOR APPROVAL TO AWARD A CONTRACT INCLUDING OWNER'S CONTINGENCY PURSUANT TO INVITATION TO BID (ITB) NO. 2017-105-ZD FOR MIDDLE BEACH RECREATIONAL CORRIDOR (MBRC) PHASE II – SECTION 2 (FROM 46TH STREET TO 53RD STREET) FM 251271-5. 

RECOMMENDATION

The administration recommends that the Mayor and City Commission of the City of Miami Beach, Florida to approve the City Manager’s recommendation pertaining to the bids received, pursuant to ITB 2017-105-ZD, Middle Beach Recreational Corridor (MBRC) Phase II – Section 2 (From 46th Street to 53rd Street).

ANALYSIS

The Middle Beach Recreational Corridor project is a part of the larger Atlantic Greenway Network (AGN), which is a system of bikeways/pathways designed to promote alternative transportation.  The Commission instructed staff to redesign the pathway to a wider width of 25 feet, where possible, to better accommodate pedestrians and bicyclists.  The path will continue the Middle Beach Recreational Corridor, from 46th street to 53rd street.  This section of the Middle Beach Recreational Corridor will be partially funded through an FDOT Local Agency Partner grant in excess of one million dollars.

 

This project consists of the construction of an on grade ADA compliant pedestrian paver walkway, with bollard lights, landscaping and irrigation. The path will run north from approximately 46th Street to 53rd Street. Exotic dune vegetation will be removed and replaced with dune enhancements such as native dune vegetation species and beach compatible dune fill and irrigation will be provided for the landscaping. The proposed path lighting will meet Florida Fish and Wildlife Commission’s marine turtle nesting requirements.

 

ITB PROCESS

ITB No. 2017-105-ZD, was issued on July 13, 2017, with a bid opening date of September 1, 2017.  Three (3) addenda were issued. The Procurement Department issued bid notices to 615 companies utilizing www.publicpurchase.com website.  Eighty (80) prospective bidders accessed the advertised solicitation. The notices resulted in the receipt of four (4) responses from: Aarya Construction & Design, Inc., JRT Construction, Co., The Stout Group, LLC, and West Construction, Inc. (See attachment A).

 

The bid submittal from Aarya Construction & Design failed to comply with the minimum requirements as stated in the ITB and, accordingly, their bid was deemed non-responsive.

 

The ITB stated that the lowest responsive, responsible bidder meeting all terms, conditions, and specifications of the ITB will be recommended for award.  In its due diligence, the Procurement Department verified that the lowest responsive bid submitted by JRT Construction, Co. met the requirements of the ITB, including:

 

  1. Licensing Requirements: Bidders shall be state certified and licensed General Contractor in the State of Florida to be considered for award.

     

    JRT Construction is State certified as a General Contractor. State license number is: CGC1505433 and expires on August 31, 2018.

     

  2. Previous Experience: Bidders shall submit at least three (3) individual references, one (1) of which must be federally funded, exemplifying their experience in projects similar in scope and volume involving construction of an on-grade ADA compliant pedestrian paver walkway with pedestrian lights, landscaping and irrigation, within environmentally sensitive areas and/or within proximity to sea-turtle nesting zones. References must be projects completed or in progress within the last five (5) years.

     

    JRT Construction submitted a total of fourteen (14) projects similar in scope and volume of work detailed within the contract documents and these emphasized their experience with the services required for Middle Beach Recreational Corridor Phase II, Section 2.  

     

  3. Bidder must have the capability to provide a performance and payment bond for the project. The City reserves the right to require performance and payment bonds from the successful bidder. Bidders shall submit a Letter from an A-rated Financial Class V Surety Company, indicating the company’s bonding capacity, in the amount not less than one hundred percent of the total base bid amount.

     

    The bid response from JRT Construction was accompanied by a bonding capacity letter from Nielson, Hoover & Company, Inc. (NHC) dated August 30, 2017. The capacity letter indicated that JRT Construction has been extended a bonding facility, which will support projects up to $ 38 million.  NHC is rated A + (Superior)/XV by A.M. Best.

     

  4. Financial Stability and Strength: The Bidder must be able to demonstrate a good record of performance and have sufficient financial resources to ensure that they can satisfactorily provide the goods and/or services required herein.

     

    JRT Construction’s latest Supplier Qualifier Report from Dun & Bradstreet indicates that they have a Supplier Evaluation Risk (SER) rating of 3. The lower the score, the lower the risk.

     

    JRT Construction has been deemed the lowest responsive and responsible bidder meeting all terms, conditions, and specifications of the ITB. As a requirement of this federally funded project, FDOT had to concur with the City’s determination that JRT Construction has met all of the terms, conditions, and specifications of the ITB. FDOT’s concurrence was received on October 9, 2017. Below is a brief summary of the firm.

     

According to the information provided by the firm, JRT Construction has been in business since 2003, it is a registered small business enterprise (SBE) and minority/women business enterprise (M/WBE). JRT Construction is state certified as a General Contractor and its Chief Executive Officer and primary qualifier, is accredited as LEED AP Building Design + Construction (LEED AP BD+C), which shows expertise in the design and construction phases of green buildings, serving the commercial, residential, education, and healthcare sectors. Currently, JRT Construction is working alongside the City of Miami Beach’s Office of Capital Improvements Projects to provide construction services for Section 1 of Middle Beach Recreational Corridor Phase II. These services are similar in scope and volume to those requested for Section 2. Additionally, JRT Construction has listed Regatta Park, Amelia Earhart Park Soccer Complex, and Pelican Marina Utilities Replacement as projects that entail similar scope and volume as MBRC Phase II, Section 2.  

CONCLUSION

After considering the bid received and the evaluation of staff, pursuant to ITB 2017-105-ZD, I recommend that the Mayor and City Commission of the City of Miami Beach, Florida, approve the award of a contract to JRT Construction, Co., the lowest responsive, responsible bidder to the ITB; and further authorize the Mayor and City Clerk to execute a contract.
