| The administration recommends that the Mayor and City Commission of the City of Miami Beach, Florida to approve the City Manager’s recommendation pertaining to the bids received, pursuant to ITB 2017-215-ZD, Continuing Services (As Needed) For The Construction Of Seawalls Type II, III, and IV, Citywide.

| Many of the seawalls throughout the City have exceeded their service life and require replacement/ repairs in order to extend their service life considerably. In December 2015, City Commission approved the award for a continuing services contract for the construction of type II seawalls, Citywide. In order to further the efforts of the replacement and repairs of the City’s deteriorating seawalls, the City through this ITB seeks to establish a continuing services contract for the construction of seawalls type II, III, and IV, Citywide, on as-needed basis as determined by the City. The City will prioritize seawall replacement/repairs as funding becomes available.
ITB PROCESS
ITB No. 2017-215-ZD, was issued on April 19, 2017, with a bid opening date of May 2, 2017. Two (2) addenda were issued. The Procurement Department issued bid notices to 141 companies utilizing www.publicpurchase.com website and eight (8) companies via email notification. Forty one (41) prospective bidders accessed the advertised solicitation. The notices resulted in the receipt of five (5) responses from: David Mancini & Sons, Inc., Ebsary Foundation Company, Interstate Construction, LLC, Kearns Construction Co., Pac Comm, Inc., and Shoreline Foundation Inc. See tabulation sheet (Attachment A).
After review of bids received, the Administration is recommending award to a primary, secondary, and tertiary bidder (in the event that primary is unable to perform) as follows: Shoreline Foundation, Inc., as the primary lowest responsive bidder, Kearns Construction Co., as secondary lowest responsive bidder, and Ebsary Foundation Company, as the tertiary lowest responsive bidder.
The successful bidders’ contracts shall be executed for a period of three (3) years, and may be renewed at the sole discretion of the City, through its City Manager, for two (2) additional one (1) year terms. There is no guarantee of work during the contract term. Projects will be assigned on as-needed basis at the discretion of the City. Funding for future years is contingent on approval of future year budgets.
The contract will offer more flexible resources to ensure that the Public Works Department fulfill the construction of seawalls, Citywide, on an as-needed basis as determined by the City, in a timely manner while always securing the lowest cost.
In its due diligence, the Procurement Department verified the following:

Licensing Requirements: Bidders shall be state certified and licensed General Contractors to be considered for award.

Previous Experience: Bidders shall submit at least three (3) individual references exemplifying their experience in seawall construction projects. References must be projects completed or in progress within the last five (5) years.

Bonding Capacity: Bidder must have the capability to provide a performance and payment bond for the project(s). The City reserves the right to require performance and payment bonds from the successful bidder. Bidders shall submit a Letter of Intent from an A-rated Financial Class V Surety Company to bond the project.

Financial Stability and Strength: The Bidder must be able to demonstrate a good record of performance and have sufficient financial resources to ensure that they can satisfactorily provide the goods and/or services required herein.
Shoreline Foundation, Inc., Kearns Construction Co., and Ebsary Foundation Company met the minimum eligibility requirements set for this solicitation.
Below is a brief description of all firms recommended for award:
SHORELINE FOUNDATION, INC.
According to the information provided by the firm, Shoreline Foundation, Inc. was founded in June of 1986 and is a fully licensed, insured and bonded contractor capable of handling marine, heavy highway and deep foundation specialty construction projects. Through this diversification, they are able to execute projects throughout the United States with emphasis in Florida, the Bahamas and the Caribbean.
KEARNS CONSTRUCTION COMPANY
According to the information provided by the firm, Kearns Construction Company is a Florida based general contractor that performs primarily marine construction, environmental restoration, commercial diving, and tremie pour services. Kearns Construction Company prides itself in being a family and friend owned company that works to create an atmosphere of trust and comradery among its employees. As a result, Kearns’ may deliver quality work and build strong relationships with its clients.
EBSARY FOUNDATION COMPANY
According to the information provided by the firm, since 1922, Ebsary Foundation Company has been a family owned and operated business with a deep-rooted belief in family values for four generations. It is headquartered along the Miami River, which gives Ebsary the ability to conveniently access its top-of-the-line marine equipment in all Florida Waterways, while still performing all forms of land based foundation construction. Ebsary specializes in innovative foundation and heavy land and marine construction services; which include, Augered Cast-in-Place Foundation Piling, Steel Sheet Piling and Support of Excavation, Design and Construction of Cofferdams, Tremie Seal placement, Noise Barrier Walls, Driven Concrete, Steel and Timber Piling, Seawalls and Bulkheads, Mooring Dolphins and Fender Systems, Docks and Marinas, Bridge Construction and Dredging.

| After considering the bids received and the evaluation of staff, pursuant to ITB 2017-215-ZD and in an effort to expedite the construction of seawalls type II,III, and IV as the need arises, I recommend that the Mayor and City Commission of the City of Miami Beach, Florida, approve the award of a contract to: Shoreline Foundation, Inc., the lowest responsive bidder, as the primary vendor; Kearns Construction Co., the second lowest responsive bidder, as the secondary vendor; and, Ebsary Foundation Company, the third lowest responsive bidder, as the tertiary vendor; and. further authorize the Mayor and City Clerk to execute the contract.

| The costs of the related services are subject to funds availability approved through the City’s budgeting process for specific projects. Grant funding will not be utilized for this project.
