| SUBJECT: | A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING, PURSUANT TO MIAMI BEACH RESILIENCY CODE SECTION 6.2.10(8), A REQUEST BY OSIB MIAMI BEACH PROPERTIES, LLC FOR A NONCOMMERCIAL, NON-ELECTRONIC ARTISTIC GRAPHIC AT THE ROOFTOP LEVEL OF THE NEW CITIZENM HOTEL LOCATED AT 1628-1634 ALTON ROAD, WHICH GRAPHIC EXCEEDS 100 SQUARE FEET IN SIZE, FOLLOWING APPROVAL BY THE DESIGN REVIEW BOARD ON SEPTEMBER 5, 2023. |

| | | | | | | | BACKGROUND/HISTORY
| OSIB Miami Beach Properties, LLC, is the owner of the property located at 1628-1634 Alton Road (the "Property"), and is requesting approval to allow the installation of a non-commercial, non-electronic artistic graphic located at the rooftop level of the new "citizenM" hotel on the Property.
On September 5, 2023 the Design Review Board (DRB) reviewed and approved an artistic super graphic for the Property (see attached illustrations). The graphic / mural is entitled "citizenM Miami South Beach Hotel” and conceived by assume vivid astro focus (avaf), an internationally recognized art collective founded by artist Eli Sudbrack. The approval of the DRB is subject to the following conditions:
1. Substantial alterations or deviations from the artistic imagery approved herein either now or in the future shall be reviewed by the Design Review Board as a new application.
2. The artistic mural shall be maintained by the applicant, in a manner to be reviewed and approved by staff consistent with the Design Review Criteria and/or the directions from the Board.
3. The final exterior surface color scheme, including color samples, shall be subject to the review and approval of staff.
4. Prior to the issuance of a Certificate of Occupancy, the project Architect shall verify, in writing, that the subject project has been constructed in accordance with the plans approved by the Planning Department for Building Permit.

| | | | | | | | ANALYSIS
| Pursuant to Sec. 6.2.10(B) of the Land Development Regulations of the City Code (LDRs), pertaining to non-commercial exterior graphics and images, the maximum aggregate size of any mural, graphic or image shall not exceed 100 square feet, unless otherwise approved by and adopted by a majority vote of the City Commission by Resolution. The proposed graphic exceeds 100 square feet in aggregate size and is subject to approval by the City Commission.
The proposed graphic will be located on the north side of the site that is part of the phased commercial development project at 1212 Lincoln Road. This project spans the entire block on the west side of Alton Road, from 16th Street to Lincoln Road. Phase I of the project is complete and the second phase of the project, the northernmost portion of the site, will include retail and the City’s first “citizenM” hotel.
The applicant is proposing the installation of an artistic super graphic on the rooftop structure, along the walls of the north and east elevations, comprising a total area of 1,415 square feet. These walls are well setback from the main elevations of the building and will primarily be visible from the roof-top pool and sundeck. Most of the roof-top area will be screened from street view by landscaping.
The applicant is proposing to artistically enrich otherwise non-descript walls with a flourishing mural by assume vivid astro focus (avaf). According to the applicant, avaf creates personal expression and lust for life that is infused by multiple sources and visual traits. avaf works have been exhibited extensively and are included at the Faena Center, Museum of Contemporary Art (MCA), Museum of Modern Art (MOMA), as well as other major exhibitions.
The Administration is supportive of the proposed artistic graphic as it will enhance the wall enclosure of the elevator, bathroom, and mechanical spaces with a mural that is vibrant and compatible with the architecture. |

| The Administration recommends that the City Commission adopt the attached Resolution approving, pursuant to Miami Beach Resiliency Code Section 6.2.10(8), a request by OSIB Miami Beach Properties, LLC for a noncommercial, non-electronic artistic graphic at the rooftop level of the new “citizenM” hotel located at 1628-1634 Alton Road, following approval by the Design Review Board on September 5, 2023. |
