| SUBJECT: | 1. A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE A NON-EXCLUSIVE, PERPETUAL EASEMENT AND RELATED DONATION OF PROPERTY, PURSUANT TO FLORIDA STATUTES SECTIONS 337.25 AND 337.29, IN FAVOR OF THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT), IN THE FORM ATTACHED TO THIS RESOLUTION AS COMPOSITE EXHIBIT "1"; SAID EASEMENT CONTAINING AN EASEMENT AREA DESCRIBED AS PARCEL 802 AND HAVING APPROXIMATELY 3,338 SQUARE FEET, LOCATED ALONG A PORTION OF WEST 29TH STREET, AS SHOWN ON THE AMENDED PLAT OF SUNSET LAKE SUBDIVISION, RECORDED IN PLAT BOOK 8, PAGE 52 OF THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA, LYING IN SECTION 27, TOWNSHIP 53 SOUTH, RANGE 42 EAST, AS MORE PARTICULARLY DESCRIBED IN THE EASEMENT, FOR THE PURPOSE OF CONSTRUCTING, INSTALLING, AND MAINTAINING DRAINAGE IMPROVEMENTS, DRAINAGE STRUCTURES, ELECTRICAL PANELS, AN OUTFALL, A PUMP STATION, AND A BACK-UP GENERATOR FOR THE PUMP STATION.
2. A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE A NON-EXCLUSIVE, PERPETUAL EASEMENT AND RELATED DONATION OF PROPERTY, PURSUANT TO FLORIDA STATUTES SECTIONS 337.25 AND 337.29, IN FAVOR OF THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT), IN THE FORM ATTACHED TO THIS RESOLUTION AS COMPOSITE EXHIBIT "1"; SAID EASEMENT CONTAINING AN EASEMENT AREA DESCRIBED AS PARCEL 803 AND HAVING APPROXIMATELY 4,942 SQUARE FEET, LOCATED ALONG A PORTION OF THE CITY-OWNED PROPERTY KNOWN AS THE MIAMI BEACH BAYSHORE GOLF COURSE, ADJACENT TO STATE ROAD NO. 907/ALTON ROAD, LYING IN A PORTION OF THE NORTHWEST ONE-QUARTER (NW ¼) OF SECTION 27, TOWNSHIP 53 SOUTH, RANGE 42 EAST, AS MORE PARTICULARLY DESCRIBED IN THE EASEMENT, FOR THE PURPOSE OF CONSTRUCTING, INSTALLING, AND MAINTAINING INTELLIGENT TRANSPORTATION SYSTEM IMPROVEMENTS, INCLUDING, BUT NOT LIMITED TO, DYNAMIC MESSAGE SIGNS, DYNAMIC MESSAGE SIGN SUPPORT STRUCTURES, CCTV CAMERAS, CONCRETE POLES, CONTROLLER CABINETS, PULL BOXES AND CONDUITS. |

| | | | | | | | BACKGROUND/HISTORY
| The Florida Department of Transportation (FDOT) is planning to reconstruct Alton Road, from Michigan Avenue to Ed Sullivan Drive/43 Street, including but not limited to raising the elevation of the road, installing major drainage improvements, providing above ground enhancements, etc. (the “Project”).
On October 26, 2022, the City Commission approved Resolution 2022-32358 to enter into a Memorandum of Agreement (MOA) with FDOT and commit FDOT to undertake the design and construction of certain City-owned utility and transportation facilities along and as part of the Alton Road Reconstruction Project, from Michigan Avenue to 43rd Street.
Parcel 802:
In connection with the Project, FDOT is requesting that the City (1) grant FDOT a non-exclusive, perpetual easement (“Easement”), containing an easement area of approximately 3,338 square feet (“Easement Area”), identified as Parcel 802, located along a portion of the public right-of-way of West 29th Street, for the purpose of constructing, installing, and maintaining drainage improvements, drainage structures, electrical panels, an outfall, a pump station, and a back-up generator for the pump station. Said Easement Area lying on the amended plat of Sunset Lake Subdivision, as recorded in Plat Book 8, Page 52 of the public records of Miami-Dade County lying in Section 27, Township 53 South, Range 42 East, in the City of Miami Beach, Florida; and (2) execute a Donation of Property form pursuant to Florida Statutes Sections 337.25 and 337.29, related to the transfer of this non-exclusive Easement to FDOT for use in connection with transportation purposes; said proposed Easement and Donation of Property form is incorporated herein by reference and attached as Composite Exhibit “1” to the Resolution relating to Parcel 802, attached hereto.
Parcel 803:
In connection with the Project, FDOT is requesting that the City (1) grant FDOT a non-exclusive, perpetual easement (“Easement”) containing an easement area of approximately 4,942 square feet (“Easement Area”), identified as Parcel 803, located along the City-owned Bayshore Golf Course just east of an Alton Road right of way (ROW), for the purpose of constructing, installing, and maintaining intelligent transportation system improvements, including, but not limited to, dynamic message signs, dynamic message sign support structures, CCTV cameras, concrete poles, controller cabinets, pull boxes and conduits; said Easement Area l lying in a portion of the Northwest one-quarter (NW ¼) of Section 27, Township 53 South, Range 42 East, as more particularly described in the proposed Easement and (2) execute a Donation of Property form pursuant to Florida Statutes Sections 337.25 and 337.29, related to the transfer of this non-exclusive Easement to FDOT for use in connection with transportation purposes; said proposed Easement and Donation of Property form is incorporated herein by reference and attached as Composite Exhibit “1” to the Resolution relating to Parcel 803, attached hereto.
The City has reviewed all documents provided by FDOT and has determined the City’s property interests are not adversely affected and that the Easements would serve an important public purpose; therefore, the City Manager recommends approving the execution of the Easements in favor of FDOT and the associated Donation of Property forms. |
