LAWSUITS FILED BY OR AGAINST THE CITY OF MIAMI BEACH SINCE THE LAST REPORT
1. MELVYN KLEIN V. CITY OF MIAMI BEACH, COMCAST, NATIONAL MARINE MANUFACTURERS ASSOCIATION, CANDOCK INC., AND SURLOC FLOORING SYSTEMS, LLC, Case # 17-001390 CA 01 (Circuit Court – 11th Judicial Circuit in and for Miami Dade County).
The City was served with this complaint on February 3, 2017 alleging that on February 12, 2015, the plaintiff, Melvyn Klein, while attending the Boat Show at the Miami Beach Convention Center, got his foot caught under the edge of a raised platform associated with the Candock exhibit located at Booth 3952. Consequently, he lost his balance and fell to the ground and suffered serious injuries to his face and mouth, including damage to his dental work and several cuts and abrasions. The Plaintiff is suing co-defendants in the case including the flooring company. We shall file our answer to the complaint and propound discovery to the plaintiff. We shall also tender the case to the insurance carriers for the co-defendants in the case.
2. NORMANDY LIVING, LLC. V. THE CITY OF MIAMI BEACH, FLORIDA, A FLORIDA MUNICIPALITY, THOMAS MOONEY, IN HIS OFFICIAL CAPACITY AS THE PLANNING DIRECTOR OF THE CITY OF MIAMI BEACH, FLORIDA, RAUL J. AGUILA, IN HIS OFFICIAL CAPACITY AS THE CITY ATTORNEY FOR THE CITY OF MIAMI BEACH, FLORIDA AND THE PLANNING BOARD OF THE CITY OF MIAMI BEACH, FLORIDA, AN ADMINISTRATIVE HEARING BOARD Case # 2017-002060-CA-01 (Circuit Court - 11th Judicial Circuit in and for Miami-Dade County)
This is a subsequent legal action filed by Normandy Living, LLC that attempts to circumvent the Settlement Agreement and Hold Harmless Agreement executed by the Parties in Case No. 2016-023618-CA-01. Normandy Living, LLC has filed a three (3) count complaint against the City (including naming other individuals within the City in their Official Capacities), which Complaint seeks to recoup those costs and expenses stemming from their failed attempt to obtain approval for a Residential Detoxification Center in the City of Miami Beach.
3. FLORIDA RETAIL FEDERATION, INC. THE FLORIDA RESTAURANT AND LODGING ASSOCIATION, FLORIDA CHAMBER OF COMMERCE, INC. CEFRA, INC., START AGAIN, INC AND GAVIN SHAMROCK, INC. V. THE CITY OF MIAMI BEACH Case # 2016-031886-CA-10 (Circuit Court - 11th Judicial Circuit in and for Miami-Dade County)
Plaintiffs sued the City seeking to invalidate the City’s minimum wage ordinance, and the State of Florida intervened on Plaintiffs’ behalf. The City will vigorously defend the ordinance in court.
4. RACHELLE RABINOWITZ V. CITY OF MIAMI BEACH Case # 2017-001862-CA-01 (Circuit Court of the 11th Judicial Circuit in and for Miami-Dade County)
The City was served with this complaint on February 14, 2017 alleging that on April 24, 2015, the plaintiff, Rachelle Rabinowitz, was walking on the sidewalk in front of 4385 Collins Avenue, in Miami Beach, FL when she tripped and fell due to a broken sidewalk around a water meter cover on the sidewalk that caused the water meter cover to sink around the broken sidewalk. We shall file our answer and propound discovery to the plaintiff.
