SUBJECT:A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN AGREEMENT WITH ENVIRONMENTAL PRODUCTS GROUP INC., AS A SOLE SOURCE PURCHASE PURSUANT TO SECTION 2-367(D) OF THE MIAMI BEACH CITY CODE, FOR MAINTENANCE, REPAIRS, PARTS, AND SOFTWARE PURCHASES FOR 1) VACUUM TRUCKS MANUFACTURED BY VACTOR MANUFACTURING INC. AND 2) CCTV EQUIPMENT MANUFACTURED BY ENVIROSIGHT LLC, BASED UPON THE AGREED UPON PRICING SCHEDULE; SAID AGREEMENT HAVING AN INITIAL TERM FOR A PERIOD OF THREE (3) YEARS, WITH TWO (2) ADDITIONAL ONE (1) YEAR RENEWAL TERM OPTIONS, AT THE DISCRETION OF THE CITY MANAGER, IN THE AMOUNT NOT TO EXCEED THE FUNDS APPROPRIATED ANNUALLY FOR THE MAINTENANCE OF THE EQUIPMENT; AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE FINAL AGREEMENT UPON COMPLETION OF SUCCESSFUL NEGOTIATIONS.

BACKGROUND/HISTORY

The Public Works Department currently owns and operates four (4) specialized equipment vacuum trucks manufactured by Vactor Manufacturing, Inc., a subsidiary of Federal Signal Corporation. The vacuum trucks are critical to the maintenance of sewer and storm water infrastructure across the City. The main purpose of the vacuum trucks is to keep the infrastructure free of debris to avoid sewer back-ups and storm water flooding. 

Along with the vacuum trucks, the Public Works Department utilizes a CCTV pipe scanning system manufactured by Envirosight LLC to  inspect infrastructure condition. 

While the vacuum trucks and CCTV system can be purchased through a national cooperative agreement for public sector agencies negotiated by Sourcewell, a public sector purchasing cooperative, the maintenance, repair and related parts for the trucks and the CCTV is not available via the cooperative agreement. 

ANALYSIS

Vactor Manufacturing, Inc., a subsidiary of Federal Signal Corporation, and Envirosight LLC, the manufacturer of the vacuum trucks and CCTV system, respectively, have notified the City that the sole authorized agent in the region for maintenance, repairs, parts and software of the vacuum trucks and CCTV system is Environmental Services Group located in Deerfield Beach, Florida. 

Pursuant to Section 2-367(d)(2), the Procurement Department publicly released Intent to Sole Source (ITS) No. 2021-098-NA on December 17, 2020. The Intent to Sole Source (ITS) document provides details to potential bidders on the City’s needs and requests that any vendor that believes it can provide the City with the necessary items should submit written notification to the City for consideration. No response to the ITS was received.

Therefore, based on the notification from the manufacturers and the results of the ITS, this item requests approval to negotiate an agreement with Environmental Services Group, as a sole source purchase, for the maintenance, repairs, parts and software of the vacuum trucks and CCTV system for a period not to exceed an initial term of three years, plus two one year optional renewals. The Procurement Department will reevaluate the sole source purchase at the end of the contract term.

SUPPORTING SURVEY DATA

Results from the 2019 Resident Survey show that 69.3% of residents rated the cleanliness of neighborhood streets as excellent or good. Securing a supplier for maintenance of the Vactor trucks will ensure that sewers and storm water lines remained unclogged and properly maintained.  

FINANCIAL INFORMATION

The cost of the related services are subject to funds availability approved through the City's budgeting process. Grant funding will not be utilized for this project.

CONCLUSION

Based on the foregoing, I recommend that the Mayor and City Commission of the City of Miami Beach, Florida, approve the Resolution authorizing me to negotiate an agreement with Environmental Products Group Inc., as a sole source purchase pursuant to Section 2-367(d) of the Miami Beach City Code, for maintenance, repairs, parts, and software purchases for 1) vacuum trucks manufactured by Vactor Manufacturing Inc. and the 2) CCTV equipment manufactured by Envirosight LLC, based upon the agreed upon pricing schedule; said agreement having an initial term of three (3) years, with two (2) additional one (1) year renewal terms at the discretion of the City Manager, in the amount not to exceed funds appropriated annually for the maintenance of the equipment; and further authorize the City Manager to execute the final agreement upon completion of successful negotiations
