SUBJECT:RECOMMENDATION TO REJECT ALL BIDS RECEIVED PURSUANT TO INVITATION TO BID (ITB) 2018-054-ZD, INDIAN CREEK (SR A1A) - PHASE III IMPROVEMENTS FROM 25TH TO 41ST STREET.

RECOMMENDATION

The Administration recommends that the Mayor and City Commission of the City of Miami Beach, Florida approve the City Manager’s recommendation pertaining to the bids received, pursuant to Invitation to Bid (ITB) 2018-054-ZD, for Phase III Improvements from 25th to 41st Street.


ANALYSIS

The City sought Proposal bids from construction firms to provide construction services for the construction of the Indian Creek Dr. (SR A1A) Improvements from south of 25th Street to 41st Street.  Indian Creek Dr. (SR A1A) is a Florida Department of Transportation (FDOT) roadway and as such construction of this project shall comply with all applicable FDOT manuals, memorandums and guidelines in effect as of the date of the advertising of this project. Additionally, FDOT is providing a portion of the funding for this project. The project budget (including City and FDOT funding) is approximately $9.8 million construction budget with an additional $1,150,000 for owner’s contingency.

 

ITB PROCESS

ITB No. 2018-054-ZD, was issued on September 21, 2018, with a bid opening date of November 26, 2018.  Five (5) addenda were issued. The Procurement Department issued bid notices to 550 companies utilizing www.publicpurchase.com website and 1188 via email notification.  146 prospective bidders accessed the advertised solicitation. The notices resulted in the receipt of three (3) responses from: LEAD Engineering Contractors, LLC, David Mancini and Sons, Inc. and Ric-Man International, Inc.  Attachment A includes a tabulation of the bids received.

 

The ITB stated that the lowest responsive, responsible bidder meeting all terms, conditions, and specifications of the ITB will be recommended for award.  In its due diligence, the Procurement Department reviewed the bid submittals for responsiveness and to verify that the lowest responsive bid submitted by LEAD Engineering Contractors, LLC met the requirements of the ITB and determined that was non-responsive for failure to submit Appendix A, Form A-2, Bidder Certification Form, in its entirety and fully executed by the deadline established for the receipt of bid submittals. The City Attorney's Office has determined that failure to submit the fully completed and executed Bidder Certification Form is a material variation from the ITB that cannot be waived. Therefore, LEAD Engineering Contractors, LLC's proposal cannot be considered. In addition, on November 29, 2018 LEAD Engineering Contractors, LLC notified the City of its desire “to withdraw its bid due to honest mistakes it made in the preparation of the bid.”

 

The remaining bid submittals received from David Mancini and Sons, Inc. ($22,036,999.17) and Ric-Man International, Inc. ($24,487,863.80) significantly exceed the budget for the project in the amount of $9.8 million construction budget and an additional $1,150,000 for Owner’s Construction Contingency. 

CONCLUSION

In reviewing the bids received, I find that all bids significantly exceed the project budget. In fact, the two responsive bids are more than double the published project budget. As a result, I concur with staff's recommendation to reject all the bids, review the specifications and requirements of the project, and reissue an ITB for the required work with revised plans and specifications.

 

Therefore, pursuant to ITB 2018-054-ZD, I recommend that the Mayor and City Commission of the City of Miami Beach, Florida, approve the rejection of bids received pursuant to Invitation to Bid (ITB) 2018-054-ZD, for Phase III Improvements from 25th to 41st Street.
