SUBJECT:

AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING THE CODE OF THE CITY OF MIAMI BEACH, BY AMENDING CHAPTER 106, ENTITLED "TRAFFIC AND VEHICLES," BY AMENDING ARTICLE II, ENTITLED "METERED PARKING," BY AMENDING DIVISION 1, ENTITLED "GENERALLY," BY AMENDING SECTION 106-55, ENTITLED "PARKING RATES, FEES, AND PENALTIES; EXCEPTIONS," BY PROVIDING FOR AN ENTERTAINMENT DISTRICT PARKING ZONE AND PROVIDING PARKING METER RATES AND TIME LIMITS THEREFOR; BY AMENDING MUNICIPAL PARKING GARAGE AND PREFERRED PARKING LOT RATES AND PENALTIES, BY CREATING SUBSECTION 106-55 (B)(11), TO BE ENTITLED "P71 - 46TH STREET AND COLLINS AVENUE MUNICIPAL PARKING LOT," AND PROVIDING RATES THEREFOR; BY AMENDING THE PROVISIONS REGARDING CONSTRUCTION SPACE RENTAL FEES FOR METERED PARKING SPACES; AND, BY CREATING SUBSECTION 106-55(R), TO BE ENTITLED "HOSTEL/BED & BREAKFAST (B&B) IN RESTRICTED RESIDENTIAL ZONES," TO PROVIDE FOR DAILY PARKING PERMITS AND FEES; PROVIDING FOR CODIFICATION, REPEALER, SEVERABILITY, AND AN EFFECTIVE DATE.


RECOMMENDATION

The Administration recommends the City Commission take the following actions: 1) accept the recommendation of the Finance and Citywide Projects Committee (FCWPC) on June 8, 2018 and July 13, 2018, endorsing the proposed amendments to the City Code related to parking rate increases; and 2) approve the attached Ordinance at Second Reading Final Public Hearing on September 26, 2018.

ANALYSIS

As presented at the May 24, 2018, Commission Budget Workshop and the September 12, 2018 Commission Meeting, the Administration is recommending the following parking rate increases, commencing in FY2019, to provide the following:

 

Regulate parking in the Entertainment District 24 hours daily (currently unregulated between the hours of 3:00 AM and 9:00 AM)

 

Regulate parking at Municipal Parking No. P71, located at 46th Street and Collins Avenue 24 hours daily. Currently, this parking lot is unregulated between the hours of 6:00 PM and 8:00 AM and a prepaid flat parking rate of $20.00 for non-residents and $6.00 for Miami Beach residents is in place on weekends.  The latter mode of operations has proven to be successful and it is recommended to be expanded to 24 hours daily as a metered parking operation in lieu of attendants.  In addition to the anticipated revenue enhance, it also results in an operational expense savings of $149,000, annually.

 

Increase daily parking space rental fees (from $25.00 to $35.00 per space) for temporary use of parking spaces related to private construction activity that may pose a pedestrian and/or vehicular safety issue.

 

Increase daily hostel guest parking permit (hostels located within restricted residential parking zones) from the annual residential parking permit fee of $54.60 in most residential zones to the daily residential visitor permit fee of $3.00.

 

In addition to allowing for more effective management of these parking assets and consistency in the application of rates and hours of operation, a byproduct of these proposed rate increases is to ensure adequate funding for future capital projects and renewal and replacement of existing Parking Department assets. These recommended rate increases are being made in conjunction with the recommended reduction in the FY2019 transfer to the General Fund.

 

These items were also heard and approved at the June 8, 2018 and July 13, 2018 FCWPC Budget Briefings and at the September 12, 2018 City Commission Meeting.

 

Committee Recommendation:

 

On Monday, September 17, 2018, the Transportation, Parking and Bicycle-Pedestrian Facilities Committee (TPBPFC) strongly recommends that the City leave the meters in the Entertainment District as is – until 3:00 a.m.

 

The TPBPFC’s sentiment is that businesses are struggling and expanding the metered parking hours of enforcement would be an additional burden to the business community in light of the commercially competitive environment regionally, including Brickell, Midtown, and Wynwood.

 

It should be noted that the City of Miami is currently between first and second reading of an ordinance that would increase parking rates by as much as $1.50 per hour. Parking Rates - Proposed Increases/Impacts:

 

Proposed Amendments/Estimated Revenue Enhancements:

 

Entertainment District Meter Operational Hours (Ocean Drive to Washington Avenue and 5th to 15th Streets): $135,000

Currently, metered parking rates within the corridor of Ocean Drive to Washington Avenue and 5th to 15th Street are enforced from 9am to 3am. This proposed enhancement would increase the hours that these spaces are metered to 24 hours/day.

 

46th Street & Collins Avenue Parking Lot (P71): $539,000

Currently, metered parking at the 46th Street & Collins Avenue Municipal Parking Lot (P71), Monday to Friday, from 8am to 6pm, is $1/hour, while weekends is a flat rate of $20 for visitors and $6 for residents. This proposed enhancement would change the hourly rate to flat rate of $20 for visitors and $6 for residents, 24 hours a day. This enhancement, if approved, would also generate an additional $149,000 in expenditure savings from a reduction in parking attendant services since revenue collections will be 100% automated.

 

Daily Space Rental Construction: $224,000

This proposed modification would increase the construction daily space rental fee from $25/day to $35/day.

 

Hostel/Bed & Breakfast Residential Zones: $30,000

Currently, the annual residential parking permit rate is $54.60. This proposed enhancement would replace the annual residential parking permit rate in the Hostel/Bed and Breakfast Residential Zones with the daily parking permit rate of $3/day.


CONCLUSION

The Administration recommends the City Commission take the following actions: 1) accept the recommendation of the Finance and Citywide Projects Committee (FCWPC) on June 8, 2018 and July 13, 2018, endorsing the proposed amendments to the City Code related to parking rate increases; and 2) approve the attached Ordinance at   the Second Reading Public Hearing scheduled on September 26, 2018.
