IN RE: The applicant, the City of Miami Beach, is requesting a recommendation to the City Commission from the Planning Board, to waive the Land Development regulations for the construction of a cultural and community entrepreneurial hub and outdoor venue with entertainment. The waivers include but are not limited to the following: the requirements for a Neighborhood Impact Establishment and Outdoor Entertainment Establishment, to include waiver of Planning Board review; waiver of the design review process; front, side, sum of the side yard and rear setback requirements for structures, fences, walkways, decks, and parking; fence material requirements; rear yard open space requirements; yard elevation requirements; lot coverage limitations; non-visibility requirements for outdoor bar counters; hours of operation for an outdoor bar counter adjacent to a residential use; seating requirements for individual establishments selling beer, wine and/or liquor; size, location, and number signs; corner visibility requirements; store enclosure requirements, including visibility of mechanical equipment; the location requirements for the storage and parking of commercial vehicles; for the allowance of mobile storage containers; parking requirements; landscape requirements; and lot aggregation limitations of the City Code.
