| SUBJECT: | DISCUSSION REGARDING A NEW CONCESSION AGREEMENT BETWEEN THE CITY AND SOUTH FLORIDA SENIORS IN ACTION, INC., REGARDING THE USE OF THE AUDITORIUM AT THE SOUTH SHORE COMMUNITY CENTER, LOCATED AT 833 6TH STREET, FOR A PERIOD TO RUN COTERMINOUS WITH ITS EXISTING LEASE AGREEMENT, COMMENCING MARCH 1, 2018 AND ENDING SEPTEMBER 30, 2019 |

| | | | | | | | HISTORY:
The City of Miami Beach (“Landlord”) and South Florida Seniors in Action, Inc, a Florida not-for-profit corporation (“Tenant” or “SFSIA”), are parties to a lease agreement dated October 4, 2016 (“Lease”) for the use of approximately 142 square feet of office space (“Premises”) on the 1st floor of the South Shore Community Center, located at 833 6th Street (“Center”). The Lease was for a period of approximately three (3) years, commencing September 12, 2016 and ending September 30, 2019. The Center provides space to various not-for-profit, community service organizations that provide assistance to the Miami Beach community including Jewish Community Services, Miami-Dade Community Action Agency, Little Havana Activities and Nutrition Centers of Dade County, South Florida Workforce Investment Board and Lighthouse Church of Miami Beach.

| | | | | | | | ANALYSIS:
SFSIA uses it current office to provide various services to the elderly community in Miami Beach (i.e., food distribution, healthcare eligibility, etc.). On November 20, 2017, the Administration met with SFSIA to discuss their request to also utilize the auditorium at the Center. The auditorium consists of approximately 2,792 square feet and is currently utilized by Jewish Community Services for its senior meals program on Monday through Friday between 8:00AM to 2:00PM. The auditorium is also utilized by Lighthouse Church of Miami Beach for church services on Sundays between 9:00AM and 1:00PM.
SFSIA has requested to utilize the auditorium on Monday through Friday between 2:00PM and 6:00PM in order to provide additional services to the elderly community in Miami Beach in accordance with the schedule below. As is the case with JCS, since SFSIA would only use the auditorium on a non-exclusive, part-time basis, a concession agreement would be utilized to formalize the agreement, a draft of which is attached hereto as Exhibit A (Draft Concession Agreement).

This item was presented at the December 15, 2017 FCWPC meeting and the FCWPC recommended, as with the other groups that utilize the auditorium, SFSIA should pay rent for its use of the space. As not-for-profit entities, other tenants at the Center pay based on the operating expenses for the Center which amount to $11.06 per square foot. Based on the days/hours above, SFSIA would utilize the auditorium 20 hours per week. Utilizing the same formula as in the JCS agreement, this amounts to 16.7% of a 120 week (24 hours/day times 5 days per week=120 hours). Accordingly, the pro-rated rate for SFSIA will be $1.85 per square foot. The auditorium is 2,792 SF so the annual amount will be $5,165.20 and the monthly amount will be $430.33.
