| | | | | | | | ANALYSIS
|
Mayor Philip Levine has proposed an amendment to Section 46-157 of the Miami Beach Code. This amendment, which will amend the City's Noise Ordinance provisions, modifies the exemption provision of Section 46-157, and would result in the modification of the live or amplified portion of Subsection (11). Specifically, the amendment will remove the existing exemption from a violation of the Noise Ordinance, for those properties located on the west side of Ocean Drive, between 5th Street through 15th Street.
The removal of this exemption from Subsection 46-157(11) will serve to effectively address those noise disturbances experienced by residents and visitors, and reduce the overall quality-of-life offenses committed throughout this iconic area of the City. The amendment will facilitate the City’s commitment to protect the public health, safety and welfare from these on-going disruptions caused by excessive and unnecessary amplified sound.
