SUBJECT:

DISCUSS/TAKE ACTION, AND AUTHORIZE ADMINISTRATION TO IMPLEMENT NEW FLORIDA LAW FOR DOUBLE FINES AND TOWING WITHIN SPECIAL EVENT ZONES DURING SPRING BREAK TO THE FULLEST EXTENT PERMITTED BY LAW.


HISTORY:

Commissioner Alex Fernandez placed an item (R9 X)on the January 31, 2024 City Commission agenda to discuss/take action, and authorize the Administration to implement the new Florida law for double fines and towing within special event zones during Spring Break to the fullest extent permitted by law.

Discussion was held as part of a larger Spring Break discussion and an after-the-fact Resolution (No. 2024-32908) was adopted. During the discussion, Commissioner Tanya K. Bhatt suggested implementing special event zones continually, however, Commissioner Fernandez did not feel the tool was intended for continual use. As such, he suggested that the item be referred to the Public Safety and Neighborhood Quality of Life Committee (PSNQLC) for further discussion.

ANALYSIS

The Miami Beach Police Department (MBPD) implemented a variety of measures to contribute to the overall goal of increased public safety and the reduction of crime and disorder during the 2024 Spring Break season. 
 
During the Spring Break season, the City Manager signed an order designating a special event zone in specific areas anticipated to have a significant increase in the number of people and a disruption of the normal flow of traffic due to unpermitted promoted events. The order created geographical boundaries which the Department, in collaboration with the Florida Highway Patrol (FHP), used during the designated time periods also noted in the order. 
 
Non-criminal traffic violations that occur within the special event zone subject the operator of a motor vehicle to enhanced sanctions such as the doubling of fines and the impoundment of vehicles for up to 72 hours. Public knowledge of these sanctions creates an atmosphere of compliance, which was the Administration’s goal to reduce disorder and reckless driving patterns on the roadways. 
 
As a result, MBPD issued 58 uniformed traffic citations when the special event zones were in effect, and FHP issued 73 over the course of two specific days during this same special event designation. 
 
The City Attorney’s Office is prepared to discuss the legal implications of continual designations of special event zones with input, as needed, from the Miami Beach Police Department (MBPD).

CONCLUSION:
Following the positive effects of the implemented 2024 Spring Break measures, the Miami Beach Police Department would recommend creating a special event zone for any future major event to include Spring Break 2025.
