COMMITTEE MEMORANDUM

TO: Public Safety and Neighborhood Quality of Life Committee Members

FROM:
Alina T. Hudak

DATE: February 14, 2024

SUBJECT:

DISCUSS/TAKE ACTION REGARDING THE POLICE DEPARTMENT’S STAFFING PLAN AND APPROACH TOWARDS ENFORCEMENT OF SPEEDING VIOLATIONS AND DRIVERS WHO OPERATE THEIR VEHICLES IN A RECKLESS OR CARELESS MANNER, AND ANY RECOMMENDATIONS TO ENHANCE ENFORCEMENT FOR THESE OFFENSES.

HISTORY:

Commissioner Suarez placed a discussion item on the December 13, 2023 City Commission Agenda which was turned into a referral to the Public Safety and Neighborhood Quality of Life Committee (PSNQLC) cosponsored by Commissioners Magazine and Bhatt to discuss/take action regarding the Miami Beach Police Department's (MBPD) approach towards enforcement of speeding violations and drivers who operate their vehicles in a reckless or careless manner, and any recommendations to enhance enforcement of these offenses.

ANALYSIS

All sworn Miami Beach Police Department (MBPD) officers have the authority to stop and issue violations based on their discretion to operators of all vehicles who they witness violate local ordinance and state statutes.

The Department additionally has a corps of motorcycle officers whose primary function it is to enforce all traffic laws. Officers also conduct random and unannounced enforcement missions at hot spots around the city with members of the MBPD's Accident Investigations Unit.

While it is frustrating for a lay motorist to witness poor driving behavior, the Department is committed to consistently addressing violations throughout the city even with a limited number of officers handling a variety of calls for services and community needs. The MBPD will continue to address witnessed violations of poor and intentional egregious driving behavior.
