SUBJECT:REFERRAL TO THE PUBLIC SAFETY AND NEIGHBORHOOD QUALITY OF LIFE COMMITTEE TO DISCUSS POTENTIAL PROACTIVE ENFORCEMENT TO IDENTIFY BUSINESSES OPERATING WITHOUT A VALID CITY BTR WITHOUT WAITING FOR A RESIDENT COMPLAINT.

ANALYSIS


Please place on the January 31, 2024 agenda a referral to the Public Safety and Neighborhood Quality of Life Committee to discuss potential proactive enforcement efforts by the City’s Code Compliance Department to identify businesses operating without a valid City BTR without relying upon after the fact complaints from residents.

Recently, as a result of resident complaints, the City learned of several businesses operating unlawfully without a valid BTR, including a problematic establishment in North Beach. The City’s Code Compliance Department conducted the appropriate investigations, issued citations and the businesses either voluntarily ceased their operations or were shutdown.

The City would benefit from more robust proactive enforcement of the City’s BTR requirements, rather than wait to receive a complaint of an unlicensed business.

I am open to recommendations from City Staff and my colleagues as to the best and most effective solutions to ensure we do not simply allow more and more unlicensed establishments to spring up, before any enforcement action is taken.
