| | SUBJECT: | AMENDING THE RM-3 ZONING DISTRICT REGULATIONS IN THE MIAMI BEACH RESILIENCY CODE TO ADOPT A 12:00 A.M. OUTDOOR TERMINATION TIME FOR THE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES AT ALCOHOLIC BEVERAGE ESTABLISHMENTS ALONG THE EAST SIDE OF COLLINS AVENUE, FROM 53RD STREET TO 72ND STREET |
|
| | | | | | | | HISTORY:
| On December 13, 2023, at the request of Commissioner Alex Fernandez, the City Commission referred the attached proposal (C4 V) to the Public Safety and Neighborhood Quality of Life Committee (PSNQLC) and the Planning Board. Commissioner Tanya K. Bhatt is the co-sponsor of the proposal.
As noted in the attached referral memo, the item sponsor would like the PSNQLC to discuss a proposed amendment to the RM-3 residential multifamily, high intensity district regulations to adopt a uniform 12:00 a.m. outdoor termination time for the sale and consumption of alcoholic beverages at alcoholic beverage establishments along the east side of Collins Avenue, from 53rd Street to 72nd Street. This 12:00 a.m. cutoff would apply to both new and existing establishments. |

| | | | | | | | ANALYSIS
| Attached is a draft ordinance limiting the outdoor sale of alcohol to 12:00 a.m. for properties located in the RM-3 zoning district, on the east side of Collins Avenue from 53rd to 72nd Street. The subject ordinance was a dual referral to the Planning Board. Approximately two (2) existing establishments have a termination later than 12:00 a.m. and would be impacted should the ordinance be adopted.

| | |
| | | | | | | | CONCLUSION: The Administration recommends that the Public Safety and Neighborhood Quality of Life Committee discuss the proposal and provide a recommendation to the Planning Board.
