| SUBJECT: | A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING, PURSUANT TO MIAMI BEACH RESILIENCY CODE SECTION 6.2.10.A.1, A REQUEST BY OSIB MIAMI BEACH PROPERTIES, LLC FOR A NON-COMMERCIAL, NON-ELECTRONIC ARTISTIC GRAPHIC ALONG THE LINCOLN ROAD AND MERIDIAN AVENUE PORTIONS OF THE "SALT & STRAW" ICE CREAM STORE LOCATED AT 749 LINCOLN ROAD, WHICH GRAPHIC EXCEEDS 100 SQUARE FEET IN SIZE, FOLLOWING APPROVAL BY THE HISTORIC PRESERVATION BOARD ON NOVEMBER 14, 2023. |

| The Administration recommends that the City Commission adopt the attached Resolution. |

| | | | | | | | BACKGROUND/HISTORY
| Salt & Straw, LLC, is the tenant of the PPF LRIII Portfolio, LLC-owned property located at 749 Lincoln Road (the "Property"). Salt & Straw, LLC operates an ice cream store at the Property and is requesting approval to allow the installation of a non-commercial, non-electronic artistic graphic located within the upper façade windows and underside of the entry canopy on the Property.
On November 14, 2023 the Historic Preservation Board (HPB) reviewed and approved the artistic super graphic for the Property (see attached Exhibit A). The mural is a work of art by artist Nerea Arce and will contain no advertising or signage. The approval of the HPB is subject to the following conditions:
1. Prior to the issuance of any permit for the installation of the mural, review and approval of the City Commission, in accordance with the applicant requirements of Chapter 6 of the Land Development Regulations, shall be required.
2. The final details of the mural shall be submitted, in a manner to be approved by staff consistent with the Certificate of Appropriateness Criteria and/or the directions from the Board.
3. The mural shall not contain any signage or advertising. A plaque shall be provided with the name of the artist, date, title of the piece, and a description and explanation of the artwork, in a manner to be approved by staff consistent with the Certificate of Appropriateness Criteria and/or the directions from the Board.

| | | | | | | | ANALYSIS
| Pursuant to Sec. 6.2.10(B) of the Land Development Regulations of the City Code (LDRs), pertaining to non-commercial exterior graphics and images, the maximum aggregate size of any mural, graphic or image shall not exceed 100 square feet, unless otherwise approved by and adopted by a majority vote of the City Commission by resolution. The proposed graphic exceeds 100 square feet in aggregate size and is subject to approval by the City Commission.
The subject building was constructed in 1972 and is located within the Flamingo Park Local Historic District. The applicant, Salt & Straw, LLC, is proposing the introduction of a painted mural along portions of the Lincoln Road and Meridian Avenue facades. The mural is primarily located within the clerestory windows and will help to screen large mechanical equipment located behind these windows.
The Administration is supportive of the proposed artistic graphic as it will enhance this portion of Lincoln Road and conceal mechanical equipment within the mezzanine level. |

| The Administration recommends that the City Commission adopt the attached Resolution approving, pursuant to Miami Beach Resiliency Code Section 6.2.10(8), a request by Salt & Straw, LLC, the tenant, for a noncommercial, non-electronic artistic graphic along the Lincoln Road and Meridian Avenue portions of the “Salt & Straw” ice cream store located at 749 Lincoln Road following approval by the Historic Preservation Board on November 14, 2023. |
