SUBJECT:

DISCUSSION REGARDING AN UPDATE FROM THE MUNICIPAL PROSECUTOR ON THE AMOUNT OF REPEAT OFFENDERS ENCOUNTERED SINCE THE BEGINNING OF THE 2022 CALENDAR YEAR, THE REASON FOR THE ARRESTS AND CASE DISPOSITION. UPDATE MAY BE PROVIDED IN MEMORANDUM FORM IN THE COMMITTEE AGENDA FOR DISCUSSION AND POSSIBLE ACTION BY THE COMMITTEE. FURTHER, REQUESTING QUARTERLY UPDATES TO THE PSNQLC FROM THE MUNICIPAL PROSECUTOR VIA MEMORANDUM IDENTIFYING NEW SUBSEQUENT ARRESTS AND DISPOSITIONS.


HISTORY:

On November 16, 2022, Commissioner Alex Fernandez placed a referral to the Public Safety and Neighborhood Quality of Life Committee (“PSNQLC”) on the City Commission agenda to discuss and receive an update from the Municipal Prosecution Team as to the number of repeat offenders encountered since the beginning of the 2022 calendar year, the reason for the arrests, and the case dispositions. Commissioner Fernandez further requested quarterly updates to the PSNQLC, by way of written memorandum, identifying new subsequent arrests and case dispositions.

ANALYSIS

This item was heard by the Committee at its February 28, 2023 meeting, at which time discussion took place primarily surrounding the lack of data and information from Miami-Dade County pertaining to the case dispositions of criminal offenders.  The Committee ultimately directed that the City Attorney’s Office prepare a Resolution, for consideration by the full City Commission, urging the Miami-Dade Clerk of Courts and Miami-Dade Information Technology Department to provide the Miami Beach Police Department with case data and disposition information.

 

As a result, the City Attorney’s Office prepared a Resolution, which was adopted by the Mayor and City Commission at its April 28, 2023 meeting (Resolution No. 2023-32582), urging the Miami-Dade Clerk of Courts and Miami-Dade Information Technology Department to provide the MBPD with searchable and readily accessible, sortable and downloadable statistical data for those defendants arrested for criminal offenses within the City of Miami Beach.  In addition, the Resolution directed the City Clerk to transmit a copy of the Resolution to the Miami-Dade County League of Cities and the Miami-Dade County Association of Chiefs of Police.

 

It should also be noted that the Committee combined this Item (Item # 21) with Item # 37 “DISCUSS OPTIONS IN ORDER TO ADDRESS THE POLICE DEPARTMENT’S CONCERNS REGARDING THE CASE DISPOSITION DATA PROVIDED BY THE MIAMI-DADE COUNTY CLERK OF THE COURTS”, which was also on the February 28, 2023 PSNQLC agenda.

CONCLUSION:

The Police Department and City Attorney's Office stand ready for any further discussion or action that the Committee desires with regard to this Item and, to the extent there have been any new developments, the Police Department can provide the Committee with an update as to any progress concerning the receipt of case disposition data and information from Miami-Dade County.
