| | | | | | | | TITLE: | UPDATE TO THE LUSC COMMITTEE REGARDING THE BAYWALK ALONG THE SOUTHGATE TOWER APARTMENTS. |

| | | | | | | | HISTORY:
| On May 10, 2023, as part of a standing item on the Committee’s agenda, the City’s Office of Capital Improvement Projects (CIP) provided an update on the status of the Baywalk projects (Exhibit A), including both GOB and non-GOB funded sections. During this update, the Committee requested that an update be provided at the next LUSC meeting, regarding the status of the existing baywalk section at the Southgate Tower Apartments (900 West Avenue; DRB File 22718). |

| | | | | | | | ANALYSIS:
| An upland baywalk has been constructed at this property but has not been made publicly accessible by the property owner at this time. This is due, primarily, to a condition in the Final Order for DRB 22718, which, among other things, requires that the baywalk become publicly accessible (open to the general public) concurrent with the completion of, and public accessibility to, the public baywalk at 800 West Avenue (South Bay Club).
Recently, property ownership of the Southgate Tower Apartments has changed. Subsequent to the Committee’s meeting on May 10, 2023, the Administration met with representatives of the new owners. During the meeting, the representatives expressed the need to review this issue, understand the City’s requests and whatever implications those requests will have on the property. The Administration will continue to communicate with the new property owners in the coming weeks.
