TITLE:DISCUSS IMPROVED NOTICE REQUIREMENTS FOR PROPERTY OWNERS

HISTORY:

On November 16, 2022, at the request of Commissioner Ricky Arriola, the City Commission referred the subject discussion (C4 U) to the Land Use and Sustainability Committee (LUSC). On January 25, 2023 the item was continued to the February 15, 2023 LUSC meeting, with no discussion.

As noted in the attached referral memo, the item sponsor is requesting that the LUSC review and consider mandating proper notice to a property owner when a land use board (LUB) places an item on the agenda relating to an owner’s property or business.

ANALYSIS:

Currently there are no minimum notice requirements for discussion items that may be taken up by one of the City’s land use boards (Board of Adjustment, Design Review Board, Historic Preservation Board or Planning Board). If an action results from a discussion by a LUB, such as direction to begin the process to potentially designate a property as historic, at that point the required notice procedures, including the noticing of the property owner, would be initiated.

Mandating minimum notice requirements for discussion items by an LUB would require an amendment to the Land Development Regulations (LDRs) of the City Code.

CONCLUSION:

The Administration recommends that the Land Use and Sustainability Committee discuss the proposal and provide any applicable recommendations to the City Commission.
