SUBJECT:DISCUSSION OF BAYSHORE PARK PROJECT BUDGET

HISTORY:

On November 30, 2022, the Mayor and City Commission adopted Resolution No. 2022-32418 – Adopting the fourth amendment to the general fund, enterprise funds, internal service funds, and special revenue funds budgets for Fiscal Year 2022. The Commission discussed Capital Project Gaps, including the Bayshore Park project funding gap. The project was referred to the Finance and Economic Resiliency Committee.

Bayshore Park is approximately 19.4 acres and is located at 2300 Pine Tree Drive. The Park is surrounded by stakeholders such as Scott Rakow Youth Center, Hebrew Academy, and Miami Beach High School.

The Park design and permitting was completed and the components associated with the construction of the new park include:

 

A. Construction of a new park with children’s playground for different ages, exercise station, sports courts with tennis and pickleball markings, bathroom/office building, site furnishings, lake with circulation and ozone water treatment system, drainage system for the and infrastructure for future connection to the neighborhood drainage system, pathways, jogging trails, parking lot, dog park, lighting system (tennis/pickleball court lighting, walkway lighting and street lighting along Pine Tree Dr.), entrance and park identification signs, landscaping including the butterfly garden, lake littoral zone, tree relocation and new tree planting, new hedges, shrubs and ground cover, irrigation system, and connection to the utilities and FPL system.

 

B. One of the main components of this park is contamination remediation based on the conditions and procedures stipulated in the environmental reports and the permit(s), including the required monitoring, reporting, and certifications to receive final regulatory approvals.

 

C. The project also includes abandoning the existing water and sanitary sewer force mains and the installation of a new 20-inch water main and a 30-inch force main through the park.

On August 19, 2022, the Invitation to Bid (ITB) was issued by the Procurement Department. On October 21, 2022, the City received two (2) responses from the following firms: Burke Construction Group, Inc, and Buslam Company Partners Inc.

The ITB stated that the lowest responsive and responsible Bidder meeting all terms, conditions, and specifications of the ITB would be recommended for award. The Procurement Department and Office of Capital Improvement Projects found that the bid submitted by Buslam Company Partners Inc. for the full scope of work in the amount $31,965,025, meets the requirements. The bid documents also included 10 deductive alternates for which the contractor provided a deductive amount of $1,841,587.65.

Additionally, the Police Department requested the inclusion of CCTV security infrastructure to the scope of work. The current project does not include this scope or funding. The estimated cost for the design and construction of the CCTV infrastructure approximates an additional $1.2 million.

The bid received exceeds the current approved project budget of $26,560,190. Based on the bid amount, whether or not deductive alternates are applied and/or the CCTV infrastructure funding is added the total required project budget (including construction, design, AIPP, permitting, project management fees and owner’s contingency) ranges between $39.5 million to $42.7 million. This results in a $12.9 million to $16.2 million funding gap.


ANALYSIS:

Funding Recommendation

Administration is recommending to fund the full project including funding for the CCTV Infrastructure for the total required project budget of $42.7 million. This results in a $16.2 million funding gap. Below are recommendations on how to fund the gap.

1) Central Bayshore Neighborhood Stormwater Funds $4,002,833

Bayshore Park project includes the construction of a lake that will retain stormwater for a portion of the Central Bayshore neighborhood’s watershed. The project will help to keep surrounding roads dry by collecting stormwater runoff from flooded neighborhood streets, into the lake where it will be stored and naturally percolate into the aquifer. The total construction cost for the lake and all associated components represents 20% of the total anticipated construction cost.

The total proposed construction contract award including 10% owner’s contingency is $35,161,527. Based on the total construction contract award amount, the cost related to the neighborhood stormwater scope would be approximately $7 million, representing 20% of the construction cost.

The stormwater funding required could be supplemented by the potential $3 million Resilient Florida grant.

2) Resilient Florida Grant $3,029,472

In September 2022, the City was presented with an opportunity to submit a grant application through the Resilient Florida Program for the neighborhood stormwater scope of the project (construction of retention lake). This grant requires a 50/50 match.

 

Pursuant to provisions outlined in Section 380.093, F.S., Project applications for the Statewide Flooding and Sea Level Rise Resilience Plan will be ranked by the Florida Department of Environmental Protection and submitted to the Legislature in December 2022, and the Legislature will subsequently allocate funding through the General Appropriations Act, (the Florida state budget for FY 23-24), by May 5, 2023, with approval by the Governor by July 1, 2023.

If the grant is awarded, there may be potential issues to be addressed, depending on grant requirements.

3) Other Sources of Funding from Available Reserves for capital project gaps:

a. Mid-Beach Quality of Life fund balance - $1,327,013

b. Capital Reserve fund balance - $5,197,000

c. PAYGO fund balance - $2,673,154


CONCLUSION:

The Administration recommends funding the complete project scope, including the CCTV infrastructure as described above, for an approximate total budget amount of $42.7 million. Pending resolution of the $3,029,472 grant funding, the Administration recommends:

1) Funding the total project cost of $42.7 minus the $3 million grant for an approximate $39.7 million.
2) Present a Capital Budget Amendment to fund the remaining $13.2 million shortfall at the December 14, 2022 Commission meeting.
3) Award the construction contract to the lowest responsive and responsible bidder Buslam Company Partners Inc. plus 10% owner’s contingency in the total contract amount of $35,161,527 at the December 14, 2022 Commission meeting. 

Award subject to and contingent upon City’s confirmation of grant funding in the amount of $3,029,472 for the Project. 

4) In the event the City is unsuccessful in obtaining the Resilient Florida grant, the City will identify other potential funding sources and present a capital budget amendment to the City Commission at a future meeting to cover the $3 million dollar shortfall.
