SUBJECT:

DISCUSS IMPROVING LANDSCAPING, CLEANLINESS, AND AESTHETICS OF MIAMI BEACH DRIVE FROM 24 STREET TO 29 STREET.


HISTORY:

At its November 16, 2022 meeting, the City Commission approved a referral to the Public Safety and Neighborhood Quality of Life Committee to discuss improving landscaping, cleanliness, and aesthetics of Miami Beach Drive from 24th to 29th Streets.

 

The discussion originates from a recent Mid-Beach Neighborhood Association meeting, where residents expressed a desire to work with the City to improve the area.

ANALYSIS

The City of Miami Beach's Code of Ordinances, Section 126-16 (d), states that the maintenance of the vegetation in the right-of-way is the responsibility of the adjacent property owner up to the edge of pavement for the travel lanes, or the centerline of the right-of-way if no travel lanes are present. 

 

Additionally, Section 98-166 (c) states that all owners of unimproved property and occupants, or occupants and owners of the improved property, shall maintain their property in a clean and litter-free manner, including sidewalks, grass strips, alleys up to and including the median point of the alley, curbs, swale areas, or rights-of-way up to the edge of the pavement of any public street.

 

The maintenance of the strip of land located in Miami Beach Drive between 24th and 29th Streets would fall within the responsibility of the adjacent property owner, as per the City Code.  However, the Public Works Department is conducting thorough research into the history of Miami Beach Drive and any existing agreements that may provide clarification on routine maintenance responsibilities.  Once research is completed, Public Works will review all documents with the City Attorney's Office to determine ownership and maintenance options for this area.
