SUBJECT:REFERRAL TO THE PLANNING BOARD - AMEND CHAPTER 118 OF THE LAND DEVELOPMENT REGULATIONS, AT ARTICLE IX, ENTITLED “NONCONFORMANCES,” TO PERMIT EXISTING NONCONFORMING PACKAGE LIQUOR STORES WITHIN A LIMITED PORTION OF THE CD-2 ZONING DISTRICT TO RELOCATE TO ANOTHER LOCATION IN THE CD-2 ZONING DISTRICT, NOTWITHSTANDING THE MINIMUM DISTANCE SEPARATION AND USE REGULATIONS THAT APPLY TO THE UNDERLYING ZONING DISTRICT.

BACKGROUND/HISTORY

Please place the attached draft amendment to Chapter 118 on the July 20, 2022 City Commission meeting agenda as a referral to the Planning Board. The Ordinance amends Chapter 118 of the Land Development Regulations, at Article IX, entitled “Nonconformances,” to permit existing nonconforming package liquor stores within a limited portion of the CD-2 zoning district to relocate to another location in the CD-2 zoning district, notwithstanding the minimum distance separation and use regulations that apply to the underlying zoning district.
