SUBJECT:

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACKNOWLEDGING EARLY VOTING FOR THE NOVEMBER 8, 2022 CITY OF MIAMI BEACH SPECIAL ELECTION.


RECOMMENDATION

Approve a Resolution acknowledging early voting for the City of Miami Beach Special Election to be held on Tuesday, November 8, 2022, in conjunction with the General Election.

ANALYSIS

On November 8, 2022, Miami-Dade County (“County”) will be conducting the General Election, at which time the City of Miami Beach may authorize a Special Election to be held, to submit ballot questions to the electorate of the City of Miami Beach.

 

Section 101.657(1)(d), Florida Statutes, which governs Early Voting, requires that each County’s Supervisor of Elections commence early voting on the 10th day before an election that contains State or Federal races and end on the 3rd day before the election; providing early voting for no less than 8 hours and no more than 12 hours per day at each site during the applicable period. In addition, early voting may be offered at the discretion of the Supervisor of Elections on the 15th, 14th, 13th, 12th, 11th, or 2nd day before an election that contains State or Federal races for at least 8 hours per day, but not more than 12 hours per day.

 

Florida’s Election Code states that municipalities may provide early voting only in municipal elections that are not held in conjunction with County or State elections. Therefore, the County will be responsible for conducting the early voting activities related to the City’s Special Election on November 8, 2022. Accordingly, the Miami-Dade County Supervisor of Elections has designated the following early voting schedule for the November 8, 2022 City Special Election, and has designated Miami Beach City Hall, 1700 Convention Center Drive, and the North Shore Branch Library, 7501 Collins Avenue, as the early voting locations within the City of Miami Beach:

 

Week 1 Dates

Monday, October 24 through Friday, October 28, 2022

Saturday, October 29 to Sunday, October 30, 2022

Week 2 Dates

Monday, October 31 through Friday, November 4, 2022

Saturday, November 5 to Sunday, November 6, 2022

 

The Miami-Dade County Elections Department’s final Early Voting schedule hours and locations for the November 8, 2022 General Election and City of Miami Beach Special Election, have yet to be finalized.

 

 Secure ballot intake stations (Vote-by-Mail Drop Boxes) will be available and staffed at each of the Miami-Dade County Early Voting locations, including the two Early Voting locations in Miami Beach: Miami Beach City Hall, 1700 Convention Center Drive, and North Shore Branch Library, 7501 Collins Avenue during Early Voting hours of operation. Drop boxes are drive-up and are safe.

FINANCIAL INFORMATION

The Miami-Dade County Elections Department has provided the City Clerk with an estimate of approximately $28,559.85 (Cost Estimate for One Page Ballot) and $56,217.70 (Cost Estimate in the Scenario Multiple Questions Triggers an Additional Page) to conduct the November 8, 2022 Special Election, which includes the costs associated with 14 days of Early Voting. (See Department of Election Estimates.) Additionally, the City will incur approximately $42,000 in legally mandated advertisements, required by the Florida Statutes and the City Code, to notice this Special Election.

CONCLUSION

I recommend that the Mayor and City Commission acknowledge Early Voting for the November 8, 2022 City of Miami Beach Special Election, said Early Voting to be conducted in accordance with the provisions of this Resolution. Once the Miami-Dade County Elections Department finalizes the hours and locations for the November 8, 2022 General Election and City of Miami Beach Special Election, the City Clerk will transmit the information via Letter To Commission (LTC).
