| SUBJECT: | A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), AUTHORIZING FDOT TO CONSTRUCT ADJUSTMENTS TO THE CITY-OWNED WATER AND SEWER UTILITY FACILITIES LOCATED WITHIN THE CITY LIMITS OF THE FDOT ROADWAY IMPROVEMENT PROJECT, THAT INCLUDES STATE ROAD A1A, HARDING AVENUE/ABBOTT AVENUE, FROM 96TH STREET TO INDIAN CREEK DRIVE, IN THE ESTIMATED AMOUNT OF $202,455.00, WITH PREVIOUSLY APPROVED FUNDING. |

| The Administration recommends approving and authorizing the City Manager to execute the proposed Agreement, authorizing FDOT, through its roadway contractor, to construct the required adjustments to the City-owned water and sewer utility facilities. |

| | | | | | | | BACKGROUND/HISTORY
| The Florida Department of Transportation (FDOT) is planning to construct roadway improvements along Harding Avenue/Abbot Avenue, from 96th Street to Indian Creek Drive (the “Project”). The Project consists of milling and resurfacing, sidewalk improvements, and new pavement markings.
During the early design stages of the Project, the City held various meetings with FDOT to discuss the scope of the Project and its impacts to the existing City-Owned utilities located within the City's geographical limits. The FDOT Project requires adjustments to the City’s water and sewer castings.
FDOT and the City have determined that it would be advantageous to both parties to enter into an agreement to construct the aforementioned City-owned water and sewer adjustments by the FDOT’s roadway contractor. The Project is scheduled to begin in 2023, and will require the City to make a lump sum payment in the amount of $202,455.00, to cover the estimated construction cost of the City's utility work. Funding will be covered by the Public Works Water 425-0410-000325 and Sewer 425-0420-000325 accounts respectively.
The parties desire to enter into a utility Work By Highway Contractor Agreement, a copy of which is attached hereto, in order for the FDOT roadway contractor to construct the required adjustment to the City-owned water and sewer castings as part of the FDOT Project. |
