SUBJECT:DISCUSSION REGARDING DELAYS IN DERM PERMITTING AND ITS IMPACT ON THE CITY'S BTR APPROVAL AND ISSUANCE PROCESS.

HISTORY:

A referral from May 4, 2022 Commission Meeting by Commissioner Meiner to the Public Safety and Neighborhoods and Quality of Life Committee to discuss delays in DERM permitting and its impact on the city’s BTR approval and issuance process.

ANALYSIS

While the referral identifies DERM as a concern,  we’d like to make the distinction that DERM is just one County agency involved in what is known as the County Municipal Approval which encompasses DERM as one of the many reviews required by the County.

Per Miami-Dade County Ordinance Chapter 24 section 42.3, County approval is required before the issuance of any:

·       Building Permit;

·       Certificate of Occupancy;

·       Certificate of Completion;

·       Certificate of Use; and

·       Business Tax Receipt

 

During the building permitting process applicants are required to apply directly with the County for a Municipal Permit. County municipal approvals include projects within incorporated municipalities that may require Miami-Dade County approval reviews for Water and Sewer, Impact Fees, Environmental Resources Management (DERM). The City cannot issue a building permit until it has received the approval from the County.

During the City’s BTR application, all businesses (except residential use) in Miami Dade County are required to obtain approvals of Municipal Application for Certificates of Use, Occupancy, Occupational, or any other business license that allows the establishment of a business at a location (Municipal CU).The County’s Municipal Application for Certificate of Use process includes reviews from the Department of Regulatory and Economic Resources Environmental Resource Management Division (DERM) and/or the Miami-Dade County Water and Sewer Department (WASD). Other reviews or permits may be required based on the location and nature of the business.

CONCLUSION:

Staff from the County will be present to discuss this item further.
