TITLE:EXPEDITE THE OPENING OF THE BAYWALK AND MOVE THE REOPENING OF THE BAYWALK UP ON THE G.O. BOND PRIORITIZATION LIST; AND PRESENT THE BAYWALK PLAN TO THE LUSC COMMITTEE.

HISTORY:

On March 17, 2021 the City Commission adopted Resolution No. 2021-31630 to expedite the Baywalk and move it up on the G.O. Bond prioritization list with the direction for administration to present the Baywalk plan at a Land Use and Sustainability Committee meeting.

During the LUSC meetings held on May 26, 2021, September 14, 2021 and February 11, 2022, the Administration provided an update on the status of the Baywalk projects, including both GOB and non-GOB funded sections.

ANALYSIS:

Since the publication of the memorandum and the update to the Committee, certain projects have proceeded with their development. Updates are as follows:

• South Bay Club Condominium (800 West Avenue; DRB File 22960), Bay Garden Manor Condominium (1250 West Avenue) and Bayview Terrace Condominium (1228 West Avenue; PB File 1879)
Design and completion of these segments is funded through the GO Bond program. The consultant (ESciences) has submitted a draft feasibility study and design concepts, in order to present it to the Board of Directors for each of the properties, for discussion and approval. Geotechnical surveys have been completed. Current schedule anticipates 8 weeks to present and refine concepts and obtain property owner consensus. Seagrass surveys have been completed and found that the there will not be substantial seagrass impacts. Consultant will proceed to finalize concepts and prepare preliminary cost estimates.

• Mondrian Hotel/Mirador Condominiums (1000-1200 West Avenue; DRB File 20181)
This section obtained preliminary approval from the Florida Department of Environmental Protection (FDEP), and Miami-Dade County’s Regulatory and Economic Resources (RER). Further, coordination with the Florida Fish and Wildlife Commission (FWC) has also been completed. Remaining approvals include U.S. Army Corps of Engineers (USACE) and National Marine Fisheries Service (NMFS) acting as a commenting agency to USACE and based on feedback from the agencies the permits are expected any day. Permit applications have also been submitted to the City of Miami Beach Building Department, and comments have been received. Once the permitting is completed, the developer will commence construction.

• Lincoln Bay Towers Condominium (1450 Lincoln Road; DRB File 23218)
Revised plans and the permit application were delivered to the building’s Board of Directors for execution on June 30, 2021, and a meeting was held on July 8, 2021. The City has not yet received the executed permit application. The current Board of Directors has taken exception with the Baywalk Authorization Agreement, entered into with the City by a previous Board, and has raised some objections. The City sent a Notice of Default to the Board, for not signing the permit application, and the Board responded with additional questions. City staff has responded to the concerns raised and anticipates the Board’s approval and execution of permit applications. Construction documents for this section of the Baywalk exceeds 30% completion. In addition, as a requirement of the permit application, the adjoining property to the south, the Capri South Beach (1445 and 1470 16th Street), was also provided with a copy of the permit application for execution on June 30, August 19 and again on September 14, as the proposed baywalk will connect to their property. We have not yet received the executed copy.

• 5th Street Pedestrian Bridge
Although the developer’s design team was waiting on approval of the condominium tower permit plans prior to finalizing the bridge permit plan revisions, the team has decided to proceed with modifications to the bridge structure drawings. Once the modifications to the bridge structure drawings are performed, the permitting process with FDOT and City Building department will commence. The anticipated start date for the bridge construction is June 2023 and is expected to have a 12-month duration.

CONCLUSION:

The next time this item will be presented to the members of the Land Use and Sustainability Committee for update and discussion will be in January 2023.
