IN RE:
Review by the Planning Board of a Development Agreement as required by Section 142.423 of the City Code between the City and Lincoln Road Property Owner, L.P. (the “Developer”), which Development Agreement delineates the terms and conditions for the development of City-owned surface parking lots located at 1680 Lenox Avenue (“P25”) and 1080 Lincoln Lane North (“P26”, and together with P25, the “Properties”) for mixed-use developments consisting of (1) Class A office space, (2) ground floor retail , (3) public parking to replace the existing public parking spaces on the Properties, and (4) additional parking to satisfy off-street parking requirements for the office and retail uses, said Development Agreement also memorializes certain conditions precedent for the City’s lease of the Properties to the Developer, such leases being subject to approval by the City Commission and by a majority vote of the voters in a City-wide referendum.
