TITLE:DISCUSS AN AMENDMENT TO CHAPTER 122 OF THE LAND DEVELOPMENT REGULATIONS TO WAIVE OR EXEMPT AFFORDABLE HOUSING AND WORKFORCE HOUSING DEVELOPMENT FROM THE CITY’S MOBILITY FEE.

On April 6, 2022, the City Commission referred the subject discussion item to the Land Use and Sustainability Committee (C4V). The sponsor of the item is Commissioner Kristen Rosen Gonzalez.

BACKGROUND
The item sponsor would like the LUSC to discuss whether the City Commission should amend Chapter 122 of the Land Development Regulations (LDR’s), to waive or exempt affordable and workforce housing from the City’s mobility fee, to incentivize new affordable and workforce housing development in the City of Miami Beach.

ANALYSIS:

PLANNING ANALYSIS
Chapter 122 of the Land Development Regulations sets forth mobility fees, which are assessed on new development or changes of use that increase the transportation impact of development. The mobility fees are assessed based upon the number of vehicle trips that would likely result from a new project or redevelopment project.

Currently, affordable housing projects are exempt from paying a mobility fee. The proposal herein would extend that exemption to workforce housing. The Administration is supportive of this proposal, particularly in light of the potential for high mobility fees, due to the density often associated with workforce housing projects.

CONCLUSION:

The Administration recommends that the Land Use and Sustainability Committee recommend to the City Commission that a referral be made to the Planning Board to amend Section 122-5 of the LDRS, to create a mobility fee exemption for workforce housing.
