| SUBJECT: | REFERRAL TO THE LAND USE AND SUSTAINABILITY COMMITTEE TO DISCUSS CREATING MINIMUM DISTANCE REQUIREMENTS FOR VITAMIN SHOPS UNDER SECTION 142-335 OF THE CITY CODE, AND IN ANY ADDITIONAL SECTION THAT MAY BE APPROPRIATE, TO PROTECT THE INTENDED MAIN USE OF THE RESPECTIVE ZONING DISTRICT. |

| | | | | | | | BACKGROUND/HISTORY
| Recently, two stores opened on the 600 block of Lincoln Road selling cannabidiol (CBD) and tetrahydrocannabinol (THC) products. Situated within abutting storefronts, the proximity of these stores run contrary to the vision for Lincoln Road as a destination for arts, cultural and performance institutions, as well as designer boutiques, cafes restaurants, and national retail stores.
Lincoln Road is zoned as a CD-3 Commercial, High Intensity District. Section 142-335 of the City Code establishes prohibited uses within the CD-3 district including tobacco/vape dealers, medical cannabis dispensaries and pharmacy stores among others. CBD and THC stores are categorized as vitamin shops.
I would like for the Land Use Committee to discuss creating minimum distance requirements for vitamin shops under Section 142-335 of the City Code, and in any additional section that may be appropriate, to protect the intended main use of the respective zoning district. |
