| SUBJECT: | DISCUSSION REGARDING MIAMI-DADE COUNTY COMMUNITY HEALTH CENTER AT 710 ALTON ROAD. |

| | | | | | | | BACKGROUND/HISTORY
| On December 8, 2021, at the request of Commissioner Ricky Arriola, the City Commission referred a discussion item to the Land Use and Sustainability Committee (LUSC) pertaining to the potential relocation of the Miami-Dade County Community Health Center at 710 Alton Road to 683 Alton Road (item C4 AI). On February 11, 2022, the LUSC discussed the item and recommended that the City Commission consider the proposal, as well as take action on the following:
1. Discuss the draft agreement between the County and the developer of the 500 Alton Road site, as it pertains to the proposal to swap properties.
2. Amend the existing Development Agreement with the developer of the 500 Alton Road project, in order to accommodate the proposed land swap with the County.
3. Consider a referral to the Planning Board for applicable LDR amendments, to extend the Alton Road Gateway Overlay north to 8th Street.

| | | | | | | | ANALYSIS
| The developer of the 500 Alton Road project, which includes a proposed new hi-rise residential tower on Fifth Street between Alton Road and West Avenue, as well as a new public park on the balance of the site north of the former 6th Street right-of-way, is seeking to enter into an agreement with Miami-Dade County. The purpose of this proposed agreement, as contemplated by the developer, is to facilitate a property swap with the County and relocate the existing Community Health Center (currently located at 710 Alton Road) to the developer’s property across the street at 683 Alton Road.
The developer has also proposed modifications to the Development Agreement with City that would expand the area of the park and extend the Alton Road Gateway Overlay north to 8th Street, in order to develop a new mixed-use structure to the north and east of the existing park. Attached is a draft agreement prepared by the developer, as well as illustrations of the developer’s proposal for the sites.
The developers proposal also contemplates incorporating Florida Department of Transportation (FDOT) rights-of-way as part of the unified development site for the project. We have requested, through the Developer, that FDOT confirm its participation in writing, so the Administration and the City Attorney can evaluate whether LDR amendments would be required to aggregate development rights across the unified parcels or rights-of-way. FDOT’s written position will also be necessary for the City Attorney to determine the applicability of the City Charter to the proposed aggregation. |

| The Administration and the City Attorney recommend, prior to taking any action with regard to amending the LDRs or the 500 Alton Road DA, that the developer first negotiate and finalize an agreement with Miami-Dade County to facilitate the proposed relocation of the Community Health Center. Once an agreement for this transaction is in place, at that point the City can consider applicable LDR and 500 Alton Road DA amendments.
Additionally, FDOT’s written position with regard to the developer’s use of State rights-of-way will be required for the City Attorney, in consultation with the Planning Director, to evaluate the applicability of the City Charter to the proposed aggregation.
