SUBJECT:DISCUSS AND TAKE ACTION REGARDING MAINTENANCE OF TRAFFIC ISSUES ON STATE AND COUNTY-OWNED ROADS WITHIN THE CITY, AND ANY AND ALL LEGAL AND ENFORCEMENT OPTIONS THAT MAY BE AVAILABLE TO THE CITY TO MITIGATE IMPACTS TO RESIDENTS, INCLUDING AUTHORIZING THE CITY ATTORNEY TO FILE A LAWSUIT AGAINST FDOT AND/OR FDOT CONTRACTORS.

ANALYSIS

Please place on the February 23, 2022 City Commission agenda a discussion of maintenance of traffic issues on State and County-owned roads located within the City.  Specifically, I have brought certain lane closures to the City Administration’s attention only to learn that FDOT had not provided any notice to the City and had not entered into a Maintenance of Transportation (MOT) agreement with the City. Other lane closures by FDOT have well exceeded the MOT’s agreed upon times causing tremendous traffic delays during rush hour.

 

As part of this discussion, I would like for the Administration and City Attorney’s Office to address the legal and enforcement options that may be available, including authorizing the City Attorney to file a lawsuit against FDOT and/or FDOT contractors, to ensure that state and county contractors act responsibly and in accordance with their permit submittals.  I would also like for the Administration to address any impacts the City may have experienced with the recent implementation of the new County ordinance which restricts the City’s right to require right of way permits for construction-related lane closures on County-owned roads within the City, and any recommendations for mitigating traffic impacts of construction on State or County-owned roads.
