DISCUSS AND TAKE ACTION REGARDING MAINTENANCE OF TRAFFIC ISSUES ON STATE AND COUNTY-OWNED ROADS WITHIN THE CITY, AND ANY AND ALL LEGAL AND ENFORCEMENT OPTIONS THAT MAY BE AVAILABLE TO THE CITY TO MITIGATE IMPACTS TO RESIDENTS.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT), OFFICE OF THE INSPECTOR GENERAL, TO COMMENCE AN INVESTIGATION INTO POTENTIAL VIOLATION(S) OF THE CONTRACT PLANS, BY FDOT CONTRACTOR(S) AND/OR SUBCONTRACTOR(S), WITH REGARD TO UNAUTHORIZED, OR POSSIBLY IMPROPERLY AUTHORIZED, LANE CLOSURES CONCERNING THE INSTALLATION OF TRAFFIC SIGNALIZATION DEVICES ON 41ST STREET AND JEFFERSON AVENUE IN THE CITY OF MIAMI BEACH, AND, ADDITIONALLY, REQUESTING THAT THE CITY OF MIAMI BEACH OFFICE OF THE INSPECTOR GENERAL COMMENCE A SIMILAR INVESTIGATION INTO POSSIBLE SIMILAR CONDUCT BY CITY CONTRACTORS AND/OR SUBCONTRACTOR(S) ON THE 41° STREET CORRIDOR. 

Please place on the February 9, 2022 City Commission agenda a discussion of maintenance of traffic issues on State and County-owned roads located within the City.  Specifically, I have brought certain lane closures to the City administration’s attention only to learn that FDOT had not provided any notice to the City and had not entered into a Maintenance of Transportation (MOT) agreement with the City. Other lane closures by FDOT have well exceeded the MOT’s agreed upon times causing tremendous traffic delays during rush hour.

As part of this discussion, I would like for the Administration and City Attorney’s Office to address the legal and enforcement options that may be available to the City to ensure that state and county contractors act responsibly and in accordance with their permit submittals.  I would also like for the Administration to address any impacts the City may have experienced with the recent implementation of the new County ordinance which restricts the City’s right to require right of way permits for construction-related lane closures on County-owned roads within the City, and any recommendations for mitigating traffic impacts of construction on State or County-owned roads.
