SUBJECT:DISCUSSION REGARDING IMPROVING RESIDENTIAL BUILDING PERMIT PROCESS AND COMPLIANCE WITH NEW STATE LAW.

HISTORY:

HB 1059 was passed into law by the state in the 2021 legislation session and becomes effective on October 1st, 2021. A synopsis of the legislation is provided as attachment A. The effort to comply with the section of the law that applies to building permits, both residential and commercial, is being led by the Building Department.

ANALYSIS

All the departments which are involved in the review the Building Permitting process have worked together to comply with the requirements of the new law including but not limited to the following steps.

 

1. All departments have worked together to create a list of every permit type with information on documents required for permit issuance. This comprehensive list with information from all departments has been compiled and will be made available online as a checklist for each permit type. Applicants must adhere to the list in order for the application to be deemed complete and plan review to begin.

 

2. Reports were created to identify the longest plan that is waiting to be reviewed by type (residential/commercial) and trade or department as well as the number of plans awaiting review. This report will help departments/sections identify potential issues with staffing and need for possible overtime to provide the proper turnaround times as mandated by the state.

 

3. Two new permit types were created; a residential revision and residential shop drawings to comply with the state timelines on all residential permits.

 

4. Worked with the City Attorney’s Office to ensure that the letter of the law is followed and documents and notices clearly inform the customer (user) of their legal requirements with respect to timelines and permit corrections.

 

a. Customers on residential permits will need to provide complete corrections within 10-days of notification

 

b. Residential permit applicants will be allowed two cycles of plan review and if the submission is not complete or deficient will be required to reapply for permit.

 

5. Worked with the permitting software to address several items.

 

a. Reconfigure the timelines for residential permits.

 

b. Updating the application to include the opt in an opt out option on all permits.

 

c. Adding a permit status of “Denied” for applicants that opt in and do not meet the state mandated timelines or failure to correct the submission.

 

d. Creating additional reports to identify permits that are reaching their review timeline.

We have reviewed the laws and the requirements and feel confident that we can meet with the mandated timelines, however there are concerns that applicants may need to reapply and pay multiple upfront fees if they opt in and cannot meet the strict state mandated requirements.

Community Outreach
The Building Department is hosting a webinar that highlights the change that HB1089 will produce in the permit process, Friday, September 24th 10am to Noon and Monday, September 27th 4pm to 6pm. These sessions will be recorded, and the recording will be made available online.
