SUBJECT:DISCUSSION REGARDING NOISE EMANATING FROM UNORTHODOX VEHICLES TO INCLUDE GOLF CARTS, SLINGSHOTS, ETC.

HISTORY:

At the February 10, 2021 City Commission Meeting, Commissioner Samuelian placed a referral to the Neighborhood and Quality of Life Committee (NQLC) to discuss resident reports of noise disturbances emanating from golf carts, slingshots and other unorthodox vehicles and review methods to ameliorate the noise concern.

ANALYSIS

Following Miami Dade County Ordinance 21-28, the Miami Beach Police Department currently conducts enforcement of noise emanating from a vehicle by:

 

  1. Issuing a VERBAL WARNING to the driver
  2. Making an arrest (NOT a preferred option)

 

Under County Ordinance 21-28 unreasonably loud, excessive, unnecessary or unusual noise is ARRESTABLE.

The Police Department can no longer use state statute 316.3045 (operation of radios or other mechanical sound-making devices or instruments in vehicles) as it has been deemed unconstitutional.

 

Currently, the Department has no additional venues to address noise originating from vehicles such as golf carts and slingshots, etc., and we welcome a Committee discussion on any additional methods brought forth to alleviate this concern.
