SUBJECT:

AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 6 OF THE CODE OF THE CITY OF MIAMI BEACH, ENTITLED “ALCOHOLIC BEVERAGES,” ARTICLE I, ENTITLED “IN GENERAL,” SECTION 6-3 THEREOF, ENTITLED “HOURS OF SALE/VIOLATIONS,” TO AMEND THE HOURS OF PACKAGE SALES OF ALCOHOLIC BEVERAGES (WHICH INCLUDE SALES OF ALCOHOL FOR OFF-PREMISES CONSUMPTION) IN SPECIFIED AREAS OF THE CITY; AND PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE.


RECOMMENDATION

The Administration recommends that the City Commission approve the subject Ordinance at First Reading and schedule a Second Reading / Public Hearing for April 21, 2021.

BACKGROUND/HISTORY

On October 31, 2017, the Mayor and City Commission adopted Ordinance No. 2017-4151, amending the hours of package sales of alcoholic beverages in the MXE mixed use entertainment district and in the adjoining CD-2 commercial, medium intensity district, to terminate package sales in the subject areas at 8:00 p.m. each day. On January 16, 2019, the Mayor and City Commission adopted Ordinance No. 2019-4234, amending the hours of package sales of alcoholic beverages in a portion of the CPS-2 Commercial Performance Standard, General Mixed Use district abutting the MXE and CD-2 districts to terminate package sales in the subject areas at 8:00 p.m. each day.

ANALYSIS

The attached Ordinance amends City Code Section 6-3, entitled “Hours of sale/violations,” to amend the hours for package sales of alcoholic beverages (which include sales of alcohol for off-premises consumption) in the following areas:

1. CD-3 districts, south of Collins Canal and Lake Pancoast;

2. CD-2 district, between Washington Avenue and Collins Avenue, from 17th Street to 20th Street; and

3. RM-3 district, east of Collins Avenue, from 16th Street to 21st Street.

As to the subject areas, the Ordinance changes the commencement time for package liquor sales from 8:00 a.m. to 10:00 a.m., and changes the termination time for package liquor sales to from 12:00 a.m. to 8:00 p.m. The following are the existing package stores that would be required to comply with the new hours of operation, should the proposed Ordinance be adopted by the City Commission:

1. 7-ELEVEN - 350 Lincoln Road (Note this establishment is legal non-conforming, as convenience stores are now prohibited on Lincoln Road, between Collins Avenue and Alton Road);

2. I LOVE LIQUOR - 1632 Collins Avenue;

3. I LOVE LIQUOR - 1678 Collins Avenue; and

4. WALGREENS – 1669 Collins Avenue.

The attached map shows the specific areas where the new hours would apply, as well as the location of the existing establishments noted above.
