SUBJECT:REFERRAL TO THE LAND USE AND SUSTAINABILITY COMMITTEE AND THE PLANNING BOARD - AMENDMENT TO THE LIST OF PROHIBITED USES IN THE SUNSET HARBOR NEIGHBORHOOD.

RECOMMENDATION

The administration recommends that the City Commission refer the item to the Land Use and Sustainability Committee and the Planning Board for consideration and recommendation.

BACKGROUND/HISTORY

On June 30, 2020 the Land Use and Sustainability Committee discussed a proposal to establish a Neighborhood Identity Overlay District. The legislation pertaining to this overlay is pending before the City Commission.

ANALYSIS

The Art Deco/MiMo Commercial Character Overlay District, as well as other defined areas of the City, contain prohibitions and restrictions on certain types of nuisance uses. These include the following:

 

  • Pawnshops
  • Tobacco/Vape Dealers
  • Check Cashing Stores
  • Convenience Stores
  • Occult Science Establishments
  • Souvenir and T-Shirt Shops
  • Tattoo Studios.

 

As part of the June 30, 2020 LUSC discussion regarding the Formula Commercial Overlay for Sunset Harbor, staff had recommended that these types of uses be addressed in the Sunset Harbour Neighborhood. Accordingly, it is recommended that an ordinance amendmment be referred to the LUSC and the Planning Board, to prohibit the above noted uses in the Sunset Harbor neighborhood.

 

 

CONCLUSION

The administration recommends that the City Commission refer the item to the Land Use and Sustainability Committee and the Planning Board for consideration and recommendation.
