The Administration recommends that the Mayor and City Commission of the City of Miami Beach, Florida approve the City Manager’s recommendation pertaining to bids received, pursuant to ITB 2020-125-AY, continuing services (as needed) for the construction of seawalls citywide.

The purpose of this bid is to establish a continuing services contract for the construction of seawalls, Citywide, on an as needed basis as determined by the City.

It is the City’s intent to award this contract as a push button contract. Push button contracts are extensively utilized by agencies such as FDOT to expedite to critical projects via a competitively solicited indefinite quantity contract. When items are needed, the city will select the awarded vendor that has the best pricing and availability for the sum of the items needed for the particular need identified, on a case by case basis. These types of continuing contracts are authorized under Florida law. Awarding projects via a push button contract allows the City to expedite critical infrastructure projects while benefiting from competitively solicited pricing.

The ITB was issued on July 10, 2020, with bid opening date of August 24, 2020. The Procurement Department issued bid notices to 32,150 companies utilizing www.bidsync.com website. 123 prospective bidders accessed the advertised solicitation. The notices resulted in the receipt of seven (7) responses from: Bunnell Marine, LLC (“Bunnel”), David Mancini & Sons, Inc (“David Mancini”), Ebsary Foundation Company (“Ebsary”), Kearns Construction Company (“Kearns”), Lambert Bros (“Lambert”), Ric-Man Construction Florida, Inc. (“Ric Man”) and Shoreline Foundation, Inc. (“Shoreline”). See Attachment A for a tabulation of bids received.

The ITB stated that the responsive, responsible bidder(s) meeting all terms, conditions, and specifications of the ITB will be recommended for award.  Ric Man failed to comply with the minimum eligibility requirements regarding previous experience stated in the ITB. Therefore, the bid submitted by Ric Man has been deemed non-responsive and cannot be considered. Staff has verified that the bids submitted by the remaining six (6) bidders met the requirements of the ITB and can be considered.

Below is a brief summary of the six (6) bidders as articulated in their bid submittals and staff's experience with each bidder in addition to references received, as applicable.

Bunnell Marine, LLC:

According to its proposal, Bunnell Marine, LLC, was founded in Miami in 1941. They have licensed marine contractor with over 40 years of experience. The firm has not previously completed work for the City, but all references provided, including Bayview Tower, Gluck, Ramin Designs, LLC. provide positive feedback.  In addition, Bunnell Marine, LLC is a certified Veteran-Owned Business. 

David Mancini & Sons, Inc

David Mancini & Sons are a firm that was incorporated in 2010 and with multiple experience with the City of Miami Beach. The firm has completed work for the City, with satisfactory feedback, including projects at the North East Convention Center and Crespi Boulevard. In addition, the City of Miami also provided positive feedback.

Ebsary Foundation Company

For more than 90 years, Ebsary Foundation Company has been performing marine and foundation construction throughout the State of Florida and across the Caribbean. Headquartered along the Miami River, the firm has provided references which merit positive feedback from Palace Condominium Association, Town of Medley, and 121 Marina Seawall.

Kearns Construction Company

Kearns Construction Company is a Florida based general contractor that performs primarily marine construction, environmental restoration, commercial diving, and tremie pour services. Founded in 2001, the firm has provided positive references from companies and municipalities such as Marina Palms and City of Key West.

Lambert Bros

Lambert Bros. Inc. was incorporated in the State of Florida in April 2000 and is family owned and operated. Although the firm has not previously completed work for the City, it has recently been awarded the project for the 77^th street bridge over East Biscayne Point Canal repairs. In addition, references were provided with positive feedback from City of Tamarac, Palm Beach County, and Florida Department of Transportation.

Shoreline Foundation, Inc.

Shoreline Foundation Inc. was founded in June of 1986 and is a fully licensed, insured and bonded contractor capable of handling your marine, heavy highway and deep foundation specialty construction projects. The firm has also provided feedback from companies such as Eden Isles Condominium, San Remo Condo, and Colonial Club Condominiums. It is important to note that the FDOT had placed a moratorium on the award of work to Shoreline for failures on a previous project. However, the moratorium has expired and records indicate that no further action or restrictions with regard to awarding work to Shoreline exist. 

In order to assure that the City has contractors that can provide services as necessary, it is in the City's best interest to award all responsive and responsible bidders, under a push button contract selection. When Work is identified by a City representative, the Contractor who provides all services needed and is the lowest for the project based on prices submitted in Appendix A, Cost Proposal Form, will be selected to complete the Work. See Attachment A for all bidders meeting all terms and conditions of the ITB.

The cost associated to establish a continuing services contract for the construction of seawalls for the City of Miami Beach is subject to the funds availability approved through the City’s budgeting process. The annual costs are anticipated to be approximately $1,500,000.00; However, additional funds may become available subject to the funds availability approved through the City's budgeting process

As previously stated, award of the ITB will establish a pool of prequalified firms that have submitted fixed unit pricing for a wide range of items or services that may be required for future work. When a specific project is ready for construction, staff will utilize the total of the unit prices submitted by each bidder for the required work to identify the contractor for the project based on overall lowest total cost for the project. These types of contracts, known as push button contracts, are common in the industry and used extensively by agencies such as the Florida Department of Transportation. They are innovative ways to expedite work while assuring the City is benefiting from pricing established through competitive solicitations.
