SUBJECT:DISCUSS AMENDING ITEM R5 O - ORDINANCE PROHIBITING THE SALE OF ALCOHOLIC BEVERAGES LATER THAN 2:00 A.M. IN THE MXE AND CD-2 ZONING DISTRICTS IN MARCH.

ANALYSIS

Presently, the above-referenced Ordinance, which is scheduled to be heard on first reading at the February 12, 2020 City Commission meeting, would require those alcoholic beverage establishments located in portions of the MXE and CD-2 districts to cease the sale of alcoholic beverages at 2 a.m. each morning, commencing the first Friday in March and continuing for a period of seventeen (17) days therefrom.  As currently drafted, the Ordinance reads as follows:

Notwithstanding the foregoing subsections (a)(1) – (a)(9), the sale and/or serving of any alcoholic beverage(s) shall be prohibited from 2 a.m. until 8 a.m., commencing the first Friday in the month of March and continuing for a period of seventeen (17) days therefrom, by any alcoholic beverage establishment located in the following districts: 

A.   The MXE mixed use entertainment district, excluding that portion of the MXE district located between 73rd and 75th Streets; or

B.  That portion of the CD-2 commercial, medium intensity district located between Pennsylvania Avenue and Collins Court, from 5th Street to 16th Street.

 

However, I believe that we should consider the following items:

 

1. The duration of the prohibition surrounding the sale of alcoholic beverages specified in the Ordinance should be reduced and, furthermore, the Ordinance would adequately address the needs of the City, and its residents, visitors and businesses with this shortened period of time.  Accordingly, please be advised that I hereby submit the following proposed amendments (with deletions stricken through and additions underlined) to the Ordinance for first reading on February 12, 2020:

 

Notwithstanding the foregoing subsections (a)(1) – (a)(9), the sale and/or serving of any alcoholic beverage(s) shall be prohibited from 2 a.m. until 8 a.m., commencing the first Friday second Wednesday in the month of March and continuing for a period of seventeen (17) twelve (12) days therefrom, by any alcoholic beverage establishment located in the following districts: 

A.   The MXE mixed use entertainment district, excluding that portion of the MXE district located between 73rd and 75th Streets; or

B.   That portion of the CD-2 commercial, medium intensity district located between Pennsylvania Avenue and Collins Court, from 5th Street to 16th Street.

 

2. Change the cessation of alcohol sales from 2:00am to 3:00am.

 

3. Create a Spring Break Committee or working group comprised of Police Department leadership, the City Manager, a representative from the Mayor’s office, a representative from the Ocean Drive Business Association, a representative from the Collins Avenue Business District, a representative from Washington Avenue Business District and a representative from the Espanola Way Business District.  This Committee/working group should meet no less than once every three days during the effective period of the change in time for the cessation of alcohol sales.
