| SUBJECT: | A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, APPROVING, AS PART OF THE
ACTIVATION OF SUPER BOWL LIV RELATED EVENTS WITHIN THE CITY
OF MIAMI BEACH, THE EXTENSION OF HOURS UNTIL 7:00 A.M. ON
JANUARY 30, 2020 THROUGH FEBRUARY 3, 2020, FOR ON-PREMISES
CONSUMPTION OF ALCOHOLIC BEVERAGES FOR CERTAIN
ALCOHOLIC BEVERAGE ESTABLISHMENTS WITH A 5:00 A.M. LIQUOR
LICENSE, SUBJECT TO THE CONDITIONS SPECIFIED IN SECTION 6-3(A)(6) OF THE CITY CODE; AND FURTHER, PROVIDING THAT THE
EXTENSION OF ALCOHOLIC BEVERAGE SERVICE HOURS SHALL BE
APPLIED ONLY TO ALCOHOLIC BEVERAGE ESTABLISHMENTS
HOLDING SPECIAL EVENT PERMITS THAT ARE APPROVED BY THE
CITY MANAGER.

| | | | | | | | RECOMMENDATION
| The Administration recommends the Mayor and Commission approve the extension of liquor sales from 5:00 AM to 7:00 AM from January 30 - February 3, 2020, during Super Bowl 2020 for establishments who are already in possession of a 5 AM liquor license and for only those establishments who meet the criteria as outlined in this memo.

| | | | | | | | BACKGROUND/HISTORY
| In 2010, Super Bowl , was held in Miami with an attendance of approximately 75,000 people. As part of the event, the following events were held on Miami Beach: South Florida Super Bowl Host Committee - Media Event 2/2/2010, NFL Super Bowl XLIV Pepsi Music Smash - 2/3/2010 and the South Florida Super Bowl Host Committee - Tide Ocean Drive Closure 2/4/2010.
On May 24, 2016, the National Football League ("NFL") awarded Super Bowl LIV to South Florida, with the game set to take place at the newly renovated Hard Rock Stadium in Miami Gardens, Florida on Sunday, February 2, 2020.
The Super Bowl has a tremendous impact and it affects small businesses, employment and the spirit of the City. Immediate beneficiaries include bars, restaurants, hotels, rentals and ground transportation. Super Bowl weekend will bring in a significant amount of foot traffic as well. According to some business owners, there’s an undeniable trickle-down effect from all the activity.

| | | | | | | | ANALYSIS
| The City of Miami Beach will host the Super Bowl on February 2, 2020. January 30, 2020 to February 3, 2020 will be a festive time in the City. As an international tourist destination, Miami Beach is known for its many attributes including its vibrant nightlife. As part of this designation, many Miami Beach bars request an extension of liquor to serve until 7 AM during Super Bowl weekend.
In the City's Major Events Plan and Special Event Guidelines, Super Bowl occurs during a designated "major event period" which makes this event eligible for the extension of alcoholic beverage service hours, subject to the conditions established in the City Code; in order to address the special circumstances for this celebration, and during other major event days and weekends within the City of Miami Beach, the Mayor and City Commission codified, in Section 6-3(a)(6) of the City Code, an established policy of allowing alcoholic beverage establishments with a 5:00 AM liquor license to continue to sell and serve alcoholic beverages for on-premises consumption until 7:00 AM during designated major event days or weekends, subject to those conditions set forth in Section 6-3(a)(6).
The City is anticipating receiving requests from various establishments prior to Super Bowl 2020 to extend liquor license allowances. At the requests of event producers for Super Bowl related events, they are seeking approval for extension of the time to sell and serve alcoholic beverages, from 5:00 AM to 7:00 AM January 30 - February 3, 2020.
The administration believes that the economic impact of extending liquor license hours will allow local businesses who are already in possession of a 5 AM liquor license to extend their liquor sales until 7 AM, provided they have an active BTR with no infractions and that they have no outstanding code violations, to secure more sales, resulting in higher Resort Tax revenues.
In order to ensure that the City of Miami Beach has done their due diligence where this is concerned, all establishments wishing to extend their existing liquor license will be required to apply for a special events permit, which will ensure that each establishment has undergone a police and fire inspection, including their life safety plans, as well as having verified an active BTR and no code violations. |

| | | | | | | | CONCLUSION
| In previous years, the City has consistently approved such requests for such impactful events, and in keeping with same best practices, the Administration is seeking approval of the liquor license extension from the Mayor and City Commission. |
