SUBJECT:REPORT OF THE OCTOBER 30, 2019 LAND USE AND DEVELOPMENT COMMITTEE MEETING: 1. DISCUSS LIMITING BIG BOX FORMULA RETAIL AND FORMULA RESTAURANTS IN SUNSET HARBOUR. 2. DISCUSSION REGARDING THE ESTABLISHMENT OF PENALTIES FOR PROPERTY OWNERS ENGAGING IN DEMOLITION BY NEGLECT. 3. DISCUSSION REGARDING DEVELOPMENT INCENTIVES FOR THE NORMANDY ISLE COMMERCIAL DISTRICT. 4. ADAPTIVE RE-USE AND ACCESSORY USES IN THE NORTH SHORE AND TATUM WATERWAY AREAS. 5. DISCUSS LIMITING BIG BOX FORMULA RETAIL AND FORMULA RESTAURANTS ON LINCOLN ROAD. 6. DISCUSSION PERTAINING TO ESTABLISHING DISTANCE SEPARATION AND CUP REQUIREMENTS FOR PACKAGE STORES, VAPING AND SMOKE STORES, TATTOO PARLORS AND RELATED USES IN NORTH BEACH. 7. DISCUSSION REGARDING TIGHT URBANISM. 8. DISCUSSION REGARDING A LAND USE AMENDMENT TO INCREASE THE MAXIMUM BUILDING HEIGHT TO 200 FEET FOR OCEANFRONT LOTS WITH A CONTRIBUTING BUILDING IN THE RM-3 DISTRICT WHEN THE DEVELOPMENT SITE IS AT LEAST 110,000 SQUARE FEET IN SIZE. 9. DEVELOPMENT REGULATIONS FOR HOTELS ON LINCOLN ROAD - 500 BLOCK ADDITION.

ANALYSIS

A Land Use and Development Committee meeting was held on October 30, 2019. Land Use Committee Members in attendance were Commissioners John Elizabeth Aleman, Mickey Steinberg and Ricky Arriola. Commissioners Mark Samuelian and Joy Malakoff were also in attendance. Members from the administration, including Susanne Torriente, Thomas Mooney, Bo Martinez, and Michael Belush, as well as members of public, were also in attendance. Please see the attached sign-in sheet.

The meeting was called to order at 9:05 AM.

1. Discuss Limiting Big Box Formula Retail And Formula Restaurants In Sunset Harbour.

AFTER-ACTION:
Commissioner Arriola introduced the item and requested a draft ordinance be prepared, focusing on fast food and formula restaurants.

MOTION - By Acclamation:
1. Continue the item to the December 2, 2019 LUDC meeting.
2. The City Attorney will draft an ordinance for review by the LUDC.
3. The administration will place a C4 referral item on the December 11, 2019 City Commission agenda, as a place holder, in anticipation of a recommendation for referral to the Planning Board.

2. Discussion Regarding The Establishment Of Penalties For Property Owners Engaging In Demolition By Neglect.

Matis Cohen commented on as-built drawings and cost.
Commissioner Steinberg commented on replication requirements, and that if the property is a certain size it should be a required replication.
Nancy Liebman commented on the history of demolition by neglect.
Silvia Costilla commented on the Byron Carlyle theater and demolition, and also high costs of renovations, and suggested that the City should incur a penalty for the Byron Carlyle.
Daniel Ciraldo commented on the Versailles.

MOTION - By Acclamation:
1. Continue the item to the December 2, 2019 LUDC meeting.
2. The administration and the City Attorney will further evaluate the recommendations noted in the LUDC memo regarding proportional fines and building registry, as well as creating a process for as-built drawings of contributing structures.
3. Recommend that the City Commission refer the proposed amendment to chapter 118, article X, pertaining to a presumption clause, to the Planning Board.

3. Discussion Regarding Development Incentives For The Normandy Isle Commercial District.

4. Adaptive Re-Use and Accessory Uses in the North Shore and Tatum Waterway Areas

AFTER-ACTION:
Commissioner Arriola introduced the item, concerning potential hotel uses along the Tatum Waterway.
Thomas Mooney provided an overview of the item’s history and recent City Commission action.
Commissioner Aleman indicated that the purpose was not to take away rental apartment units, especially for the entire area, but incentives to raise seawalls is needed, including a limited timeframe. Supportive of the hotel addition.
Commissioner Arriola indicated support for the item.
Commissioner Samuelian requested that the number of potential buildings that could take advantage of a hotel option be provided, and that there needs to be something good for the community in order to be able to support this.
Neisen Kasdin, representing Y-tech, commented on parking, incentives, and mitigating sea level rise. He recommended removing the proposed timeframe limits for hotels to get a BTR.
Daniel Ciraldo commented on seawall requirements and numbers of hotel units.
Nancy Liebman commented on the Y-Tech lawsuit and she is opposed to the addition of hotel uses.
Daniel Veitia commented on support of the hotel use proposed and need to drive investment into the buildings.
8255 Abbott Avenue resident commented on the removal of North Shore from the ordinance, as it will impact their property.
Matis Cohen commented on historic designation ‘imposed’ on property owners. Mitigation efforts are needed.
Commissioner Malakoff indicated opposition to not having a parking requirement.
Unidentified resident commented on funding for seawalls and opposition to more transient uses, and more crime and less stability for the neighborhood.

MOTION - By Acclamation:
Continue to the December 2, 2019 LUDC, with the following additional direction:
1. Include a map of eligible buildings for hotels.
2. Further modify the benchmarks and timeframes for seawalls on hotel sites.
3. Provide available data on the number of residential to hotel conversions that have taken place over the last 10 years.
4. Provide available data on the number of new hotel units over the last 10 years.

 

5. Discuss Limiting Big Box Formula Retail And Formula Restaurants On Lincoln Road.

Commissioner Arriola introduced the item and noted concern with jeopardizing economic vitality.
Commissioner John Elizabeth Aleman shared her concerns regarding the direction of Lincoln Road.
Bo Martinez provided an update from the Lincoln Road BID.
Daniel Ciraldo commented on long term vision.

Wesley Keen provided a presentation and proposal.
Commissioner Malakoff commented on permeability.
Commissioner Steinberg indicated support for enhancement opportunities in commercial corridors such as Lincoln Road, but that the Lincoln Road BID should fund.
Commissioner Samuelian indicated support for the concept.
Commissioner Aleman noted differences between commercial and residential back of house should be explored. Open to a pilot area to deal with the practical barriers.
Matis Cohen commented on North Beach alleys.

MOTION - By Acclamation:
1. Continue the item to the January 2020 LUDC meeting.
2. The administration will meet with the item proposer to identify different options for a potential pilot, including budget and operational impacts.

8. Discussion Regarding A Land Use Amendment To Increase The Maximum Building Height To 200 Feet For Oceanfront Lots With A Contributing Building In The RM-3 District When the Development Site is at Least 110,000 Square Feet in Size.
