A RESOLUTION OF THE MAYOR AND CITY COMMISSION

PURSUANT TO CITY CODE SECTION 138-204(B)(3), A
REQUEST BY 3425 COLLINS LLC FOR APPROVAL OF A
NON-ELECTRONIC ARTISTIC GRAPHIC LOCATED AT
3425 COLLINS AVENUE, WHICH GRAPHIC EXCEEDS 100
SQUARE FEET IN SIZE.

| The administration recommends that the Mayor and City Commission adopt the attached resolution, approving a temporary artist graphic that exceeds 100 square feet for the property located at 3425 Collins Avenue. |

| | | | | | | | BACKGROUND/HISTORY
| On May 16, 2018, the City Commission adopted an ordinance requiring any non-electronic (static) graphic in excess of 100 square feet to be reviewed and approved by the Commission. This ordinance limited the aggregate area of any static artistic mural or graphic to a maximum size of 100 square feet unless otherwise approved by a majority vote of the City Commission by resolution. |

| HISTORIC PRESERVATION BOARD REVIEW
On November 6, 2019, the historic preservation board reviewed and approved a request for a certificate of appropriateness for the design of the subject temporary artistic graphic banners. The Board approved the banners to be displayed for a maximum period of eight (8) months. This approval is contingent upon approval of the City Commission, as the subject banners exceed 100 square feet in size.
PLANNING ANALYSIS
On October 5, 2016, a full building permit (B1504467) was issued for the partial demolition, renovation and restoration of the existing 16-story Versailles hotel at 3425 Collins Avenue, including the total demolition of the 1955 south addition, and the construction of a new 16-story detached ground level addition, as part of a new hotel and residential development. Since that time, a significant amount of demolition has occurred, including the removal of the 1955 south addition, portions of the ground level exterior walls and all exterior doors and windows.
The applicant is currently requesting City Commission approval to display artistic graphic banners located on all four sides of the partially demolished Versailles Hotel during the construction process. The banners depict a work of art by internationally recongized artist Miya Ando and have an aggregate area of 28,778 square feet. The same banners were previously installed in November 2018 to coincide with Art Basel and were subsequently taken down in order secure the building openings with plywood, at the request of the administration.
The administration has no objection to the artistic design of the banners, which is a suitable and dynamic graphic concept for a temporary façade treatment. However, the Historic Preservation Board and planning department staff has expressed serious concerns about the structural integrity of the building, which has been open to the elements for more than five (5) years. While some structural repair work has been completed and the openings have been secured, according to the applicant the timeframe for further restoration is uncertain. Considering these concerns, the Historic Preservation Board limited the display of the banners for a period not to exceed eight (8) months from November 6, 2019, provided the City Commission approves the banners. Any extension of this timeframe will require an additional application to the Historic Preservation Board.
Finally, planning staff continues to have concerns regarding the safety of the banners. In 2017, a previously installed banner became partially detached from the south elevation of the building on at least two separate occasions, creating a very hazardous condition for the public and surrounding properties within this highly dense and congested area of Collins Avenue. In this regard, the administration recommends that the installation of the subject banners be subject to obtaining all applicable and required permits.

| | | | | | | | CONCLUSION
| The administration recommends that the City Commission approve the subject resolution, authorizing the installation of a temporary artistic graphic with a total area of 28,778 square feet. Additionally, the administration recommends the following:
1. The applicant shall substantiate, to the satisfaction of the Building Official, that the Versailles building is fully secured and protected from the weather.
2. The applicant shall obtain all applicable and required permits prior to the installation of the banners. Additionally, the engineer of record shall provide a letter certifying that the building is structurally safe. |
