| SUBJECT: | A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND THE CITY
CLERK TO EXECUTE A NON-EXCLUSIVE UTILITY EASEMENT, IN THE FORM
ATTACHED TO THIS RESOLUTION (EXHIBIT A), OF APPROXIMATELY 1,665
SQUARE FEET, IN FAVOR OF FLORIDA POWER & LIGHT COMPANY, LYING IN A
PORTION OF SECTION 27, TOWNSHIP 53 SOUTH, RANGE 42 EAST, OF MIAMI-
DADE COUNTY, FLORIDA, AT THE SITE OF THE CARL FISHER CLUBHOUSE,
LOCATED AT 2100 CONVENTION CENTER DRIVE, FOR THE INSTALLATION AND
MAINTENANCE OF UNDERGROUND UTILITY FACILITIES INCLUDING, BUT NOT
LIMITED TO, CABLES, CONDUITS, AND APPURTENANT EQUIPMENT, ALONG
THE PROPOSED 10 FOOT WIDE EASEMENT.

| The Administration recommends that the Mayor and City Commission adopt the Resolution granting the non-exclusive utility easement. |

| | | | | | | | BACKGROUND/HISTORY
| On July 25, 2018, the Mayor and City Commission awarded the construction contract (ITB 2018-032-ZD) to Critical Path Services, Inc. for the restoration of the historic Carl Fisher Clubhouse and its adjacent Annex Building. The main goal of the project is to sensibly restore the Carl Fisher Clubhouse and Annex Building and allow them to serve as an event space for the adjoining Convention Center.
In order for Florida Power and Light (FPL) to provide electrical service they have to install their service lines from an existing FPL service manhole on the property to the proposed transformer location, which will require a utility easement agreement. The contractor for the Carl Fisher Clubhouse project has installed the underground conduit and prepared the as-built drawings, from which the easement was determined.

| | | | | | | | ANALYSIS
| In order for FPL to install, operate and maintain their facilities, the City must establish and record a non-exclusive 10’ wide utility easement (Exhibit A). The proposed utility easement will have a total area of approximately 1,665 square feet, and will include the area from the manhole to the new pad mounted transformer. |

| The Administration recommends that the Mayor and City Commission adopt the Resolution granting the non-exclusive utility easement. |
