SUBJECT:

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RATIFYING A THREE (3) YEAR LABOR AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND THE GOVERNMENT SUPERVISORS ASSOCIATION OF FLORIDA (GSAF), OPEIU, LOCAL 100, FOR THE PERIOD FROM OCTOBER 1, 2018 THROUGH SEPTEMBER 30, 2021; AND AUTHORIZING THE MAYOR AND CITY MANGER TO EXECUTE THE AGREEMENT.


RECOMMENDATION

Adopt the Resolution.

ANALYSIS

The City’s workforce is divided into seven salary groups: (1) those covered by the American Federation of State, County and Municipal Employees, Local 1554 (AFSCME) bargaining unit; (2) those covered by the Communications Workers of America, Local 3178 (CWA) bargaining unit; (3) those covered by the Government Supervisors Association of Florida/OPEIU, Local 100 (GSA) bargaining unit; (4) those covered by the Fraternal Order of Police, William Nichols Lodge No. 8 (FOP) bargaining unit; (5) those covered by the International Association of Fire Fighters, Local 1510 (IAFF) bargaining unit; (6) Unclassified; and (7) “Others” (classified service employees not represented by a bargaining unit).

On September 30, 2018, the three-year collective bargaining agreement between the City of Miami Beach and the GSAF (covering the period of October 1, 2015 through September 30, 2018) expired. The City and GSAF began meeting in August 15, 2018 to negotiate a successor agreement. After six formal negotiation sessions, on May 2, 2019, the City and GSAF reached a tentative three-year agreement covering the period of October 1, 2018 through September 30, 2021.

The GSAF leadership held a ratification vote on the proposed agreement on Thursday, May 30, 2019. As per the attached email from the GSAF President, Greg Blackman, the agreement was ratified by the supervisory employee bargaining unit members.

The following is a summary of the newly negotiated terms between the parties:

COST-OF-LIVING ADJUSTMENTS (COLA)

8.1 - Wages:
COLA: October 1, 2018- 1%
October 1, 2019- 1%
October 1, 2020-1% (2% possible if general fund revenues increase by more than 11%)


OTHER FISCAL ITEMS

Section 8.21 - Skill Pay Supplement
Sr. Building Inspector and Sr. Engineering Inspector:
• 1 license or certification -$75/month
• 2 licenses/certifications--$150/month
• 3 or more licenses and certifications- $225/month

Add: Roofing license to eligible list of licenses

Public Works Department

• Class 1 license - $150/month
• Class 2 license- $75/month
• Class 3 license- $50/month

Section 8.23 - Accreditation Pay Supplement Contingent upon the Department Obtaining and Maintaining Certain Accreditations:

All bargaining unit members in PSCD shall be paid premium pay of up to $60.00 per pay period for as long as the PSCD maintains Accreditation by the International Academy of Emergency Dispatch (IAED) [$20.00 per discipline per paid period]. The three (3) Disciplines are:
1) EMD, Emergency Medical Dispatch
2) EFD, Emergency Fire Dispatch
3) EPD, Emergency Police Dispatch.

Section 8.4 - Meal Allowance
Increased allowance from $7 to $15, when needed due to OT.
Section 8.8 - Uniforms

• Uniform Allowance: sixty ($60.00) dollars per month for a total of $ 720.00 per year
• Listed employees will be reimbursed for the purchase or repair of Sun Glasses and Hats up to $125.00. The listed employees will consist of those who perform twenty percent (20%) or more of their duties outside of a building or structure and are exposed to direct sunlight

Article 15 - Tuition Assistance

Tuition reimbursement rates increased to the levels recently implemented for unclassified and “other” employees, non-pensionable; effective upon ratification.



MISCELLANEOUS

Section 1.2 Representation and Bargaining Unit
Added classifications that had been included in the unit clarification by PERC in 2016 and deleted positions no longer in existence.

Section 7.5 Overtime

Elimination of compensatory time


Section 8.1 Wages

Formalized Performance Improvement Plans and conditions

Section 8.3 Holiday Pay

Modifications to holiday pay for those required to work on holidays which are normally scheduled days off.

Section 8.12- Paid Leave

Establish criteria for identifying and dealing with abuse of sick leave.

Section 8.13 - Perfect Attendance Bonus

Added two new exceptions to remain eligible for bonus- bereavement leave and religious sick. Effective the first full pay period after December 2019.

Section 8.17 Essential Personnel (Hurricane Pay)

Adopted the same language as the AFSCME agreement.

ARTICLE 12: DRUG & ALCOHOL TESTING
Hallucinogens added to the test panel.


CONCLUSION

The Administration finds the provisions of this contract fair to the employees and fiscally responsible for the City. Therefore, adoption of this resolution is recommended. Exhibit A to the resolution is a copy of the proposed labor agreement.

The City’s outside labor counsel has reviewed and approved the contract language as in form and legal sufficiency.
