| SUBJECT: | REFERRAL TO THE PUBLIC SAFETY AND NEIGHBORHOOD QUALITY OF LIFE COMMITTEE TO DISCUSS THE APPLICABLE CRITERIA AND STANDARDS TO ADDRESS EXCESSIVE NOISE EMANATING FROM PARTY HOUSES AND PRIVATE RESIDENCES. |

| Please place on the December 13, 2023 agenda a referral to the Public Safety and Neighborhood Quality of Life Committee to discuss the applicable criteria and standard which must be met in order for the City to address and take enforcement action against private residences and party houses producing excessive and unreasonably loud noise.
Pursuant to Section 46-152 of the City Code, and Section 21-28 of the Miami-Dade County Code, reproducing or amplifying sound (music) in such a manner as to disturb the peace, quiet and comfort of the neighboring inhabitants, or at any time with louder volume than is necessary for convenient hearing for the person or persons who are in the home, is illegal. Likewise, any unreasonably loud, boisterous or raucous shouting in any residential area is prohibited pursuant to the same sections of the City and County Code. Additionally, the operation of any machine, instrument, phonograph, or device between the hours of 11:00 p.m. and 7:00 a.m. in such manner as to be plainly audible at a distance of 100 feet from the building, structure or vehicle in which it is located shall be prima facie evidence of a violation of the City and County Codes.
As set forth in the attached e-mails, City residents consistently complain about unreasonably loud music and raucous shouting and noise emanating from private residences and party houses at all hours of the evening and early morning. The excessively loud music and noise disturbances negatively impact residents’ quality of life and ability to sleep or otherwise benefit from the peaceful enjoyment of their own homes.
Accordingly, I would request that the Administration be prepared to discuss the City’s current enforcement standards, criteria, and process in responding to and addressing excessive residential noise complaints. As part of this referral, I would request that the Administration provide the Committee with any recommendations as to how the process may be enhanced in order to take any and all effective enforcement action, including shutting down these nuisance parties. I would further request that the Administration be prepared to discuss the use and role of off-duty police officers in mitigating noise disturbances at private residences and party houses. |
