| SUBJECT: | A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING, FOLLOWING A DULY NOTICED PUBLIC HEARING, THE GRANTING OF WAIVERS OF CERTAIN LAND DEVELOPMENT REGULATIONS, BY A 5/7TH VOTE, PURSUANT TO CITY CODE SECTION 142-425(D), TO ALLOW THE INSTALLATION OF A MONUMENT SIGN AT SUNSET ISLE II PARK AT THE ENTRANCE OF THE PARK; SAID WAIVERS PERTAINING TO THE REQUIREMENTS IN SECTIONS 138-4(3) AND 138-19 OF THE CITY CODE APPLICABLE TO SIGN SIZE, DESIGN, AND LOCATION.

| Approve Waivers of Certain Land Development Regulations by 5/7ths vote, pursuant to City Code Section 142-425(d), the installation of a monument sign at Sunset Isle II Park at the entrance of the park, and waiving requirements in City Code Sections 138-4(3) and 138-19 applicable to sign size, design, and location. |

| | | | | | | | BACKGROUND/HISTORY
| During the April 6, 2022 City Commission meeting, the Commission approved setting a public hearing to consider granting Waivers of Certain Development Regulations, by a 5/7th vote of the City Commission, pursuant to City Code Section 142-425(d), for Sunset Isle II Park; in order to waive requirements in City Code sections 138-4(3) and 138-19 applicable to sign size, design, and location, in order to install the monument sign at Sunset Isle II Park at the entrance of the park.
The Sunset Islands I & II Homeowners Association would like to request replacing the existing sign on the north end of Sunset Isle II Park with a new sign at the entrance of the park. Currently, there is an existing neighborhood welcome sign that has been in place for over one decade. The HOA is proposing a replacement option that is more aesthetically pleasant. |

| The Parks and Recreation Department is submitting the application for the sign since it owns and manages the park. The Department is supportive of the request from the HOA, as there is an existing sign in place. The new sign will be in the same general location and does not adversely affect the park or its use. The replacement sign is more aesthetically pleasant than the existing sign. |
