SUBJECT:DISCUSS STATUS OF SOUTH FLORIDA WATER MANAGEMENT DISTRICT ISSUES - WEST AVENUE PHASE II IMPROVEMENT PROJECT.

RECOMMENDATION

 

BACKGROUND/HISTORY

On or about February 11, 2022, City staff and members of the City Attorney’s Office and Office of Inspector General held discussions with representatives of the South Florida Water Management District (the “District”) with respect to the District’s requests for changes to the harmonization agreement that the City requires property owners execute as part of Segment 2 of the West Avenue Phase II Improvement Project.  Specifically, the District advised it may require for property owners to provide additional documentation in the form of an affidavit for the benefit of the District, and questioned whether property owners should have to either (i) sign the permits as co-applicants; or (ii) provide the City with an irrevocable easement interest for the City to proceed with the harmonization work on private property.

 

I understand that City staff and the City Attorney’s Office have responded to the District with proposed changes to the agreements, in an effort to address the District’s concerns regarding the City’s proposed harmonization efforts. 

 

I request that the Administration and the City Attorney’s Office provide the City Commission with an update as to the status of the District’s questions and concerns, and any resolution thereof.
