SUBJECT:REFERRAL TO THE LAND USE AND SUSTAINABILITY COMMITTEE - DISCUSSION REGARDING A PROPOSED AMENDMENT TO CHAPTER 106 OF THE CITY CODE TO PROVIDE FOR A LIMITED WAIVER OF THE PERMANENT REMOVAL FEE FOR ON-STREET PARKING SPACES, WHEN SUCH REMOVAL IS REQUESTED IN CONNECTION WITH AFFORDABLE HOUSING DEVELOPMENT.

ANALYSIS

Please place the  attached referral has been placed on the June 23, 2021 City Commission meeting agenda as a referral to the Land Use and Sustainability Committee (“LUSC”).
 
City Code Section 106-55 provides that “[p]rivate requests for permanent parking space or loading zone removal shall only be allowed for the purpose of creating access to an off-street parking facility or other vehicular access to the property.” The Code further provides that “the fee for the private permanent removal of a parking space or loading zone shall be the same rate as the fee in lieu of required parking.”
 
On May 18, 2021, the Affordable Housing Advisory Committee adopted a motion recommending that the City Commission waive fees associated with the removal of on-street parking spaces when such removal is requested to provide vehicular/driveway access to new affordable housing development. Again, this limited waiver would apply only to the creation of new affordable housing development.  See LTC attached. As such, I am referring this matter to the Land Use & Development Committee for further review and analysis. Please feel free to contact Diana Fontani should you need any additional information.
