| | SUBJECT: | DISCUSS ENFORCEMENT OF COUNTYWIDE CURFEW. |

| | Miami-Dade County has not lifted its countywide curfew despite the Governor moving the entirety of the State to Phase 3 of the reopening plan for Florida. A local business sued the County for its refusal to lift the curfew and the circuit court judge hearing the matter ruled in favor of the business. The County subsequently appealed the circuit court decision, and an appeals court agreed to allow the County to continue the curfew's enforcement while the appeal is decided. Miami and Hialeah are supposedly not enforcing the curfew given the original decision of the circuit court. In an abundance of caution, I ask our City Commission to direct the City Manager not to enforce the curfew until the original ruling is overturned. Many of our businesses are struggling and we need to support them when we are granted an opportunity to do so. |
